Stat. tit. 10, § 10-1430.27","heading":"Inspection, investigation, survey or evaluation of","body":"group home.\n\nA. Every group home shall be inspected at least annually by a\n\nduly appointed representative of the Department of Human Services\n\npursuant to rules promulgated by the Director of Human Services.\n\nB. The Department shall at least annually and whenever it deems\n\nnecessary inspect, survey, and evaluate each group home to determine\n\ncompliance with applicable licensure and program requirements and\n\nstandards.\n\nC. Any inspection, investigation, survey, or evaluation may be\n\nconducted without prior notice to the home. At least one inspection\n\nper group home shall be unannounced. Any licensee or applicant for\n\na license shall be deemed to have given consent to any duly\n\nauthorized employee or agent of the Department to enter and inspect\n\nthe group home in accordance with the provisions of the Group Homes\n\nfor Persons with Developmental or Physical Disabilities Act.\n\nRefusal to permit such entry or inspection may constitute grounds\n\nfor the denial, nonrenewal, suspension, or revocation of a license.\n\nD. The Department shall maintain a log, updated at least\n\nmonthly and available for public inspection, which shall at a\n\nminimum detail:\n\n1. The name of the group home and date of inspection,\n\ninvestigation, survey, or evaluation;\n\n2. Any deficiencies, lack of compliance, or violation noted at\n\nthe inspection, investigation, survey, or evaluation;\n\n3. The date a notice of violation, license denial, nonrenewal,\n\nsuspension, or revocation was issued or other enforcement action\n\noccurred;\n\n4. Proposed dates for the resolution of deficiencies;\n\n5. The date corrections were completed, as verified by an\n\ninspection; and\n\n6. If the inspection or investigation was made pursuant to the\n\nreceipt of a complaint, the date such complaint was received and the\n\ndate the group home was notified of the results of the inspection or\n\ninvestigation.\n\nE. The Department shall require periodic reports and shall have\n\naccess to books, records, and other documents maintained by the\n\ngroup home to the extent necessary to implement the provisions of\n\nthe Group Homes for Persons with Developmental or Physical\n\nDisabilities Act and the rules promulgated by the Director pursuant\n\nthereto.\n\nF. Any representative of the Office of the State Long-Term Care\n\nOmbudsman within the Office of the Attorney General or a\n\nrepresentative of the Office of Client Advocacy within the State\n\nDepartment of Health having proper identification is authorized to\n\nenter any group home licensed pursuant to the provisions of the\n\nGroup Homes for Persons with Developmental or Physical Disabilities\n\nAct, communicate privately and without unreasonable restriction with\n\nany resident of a group home who consents to such communication, to\n\nseek consent to communicate privately and without restriction with\n\nany resident of a group home, and to observe all areas of a group\n\nhome that directly pertain to the care of a resident of a group\n\nhome.\n\nG.
