Stat. tit. 10, § 10-1430.3","heading":"Department - Powers and duties","body":"The Department of Human Services shall have the power and duty\n\nto:\n\n1. Enforce any provision of the Group Homes for Persons with\n\nDevelopmental or Physical Disabilities Act;\n\n2. Issue, renew, deny, modify, suspend, and revoke licenses for\n\ngroup homes pursuant to the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act; provided,\n\nhowever, providers of group home services that have a current\n\ncontract with the Developmental Disabilities Services Division or\n\nthe Oklahoma Health Care Authority to provide group home services\n\nshall be deemed to be licensed;\n\n3. Establish and enforce standards and requirements for\n\nlicensure and operation of group homes that are subject to the\n\nprovisions of the Group Homes for Persons with Developmental or\n\nPhysical Disabilities Act and require the submission of, and to\n\nreview, reports from any person establishing or operating a group\n\nhome;\n\n4. Enter upon any public or private property for the purpose of\n\ninspecting and investigating conditions of the residents in the\n\ngroup home or for the purpose of inspecting and investigating the\n\nhome for compliance with the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act, or the\n\nstandards or requirements for licensure and operation of group homes\n\ndeveloped by the Department pursuant to the provisions of the Group\n\nHomes for Persons with Developmental or Physical Disabilities Act;\n\n5. Employ or designate personnel to conduct investigations and\n\ninspections, to make reports of the condition of group homes and the\n\nresidents of such homes, and to take necessary action pursuant to\n\nthe provisions of the Group Homes for Persons with Developmental or\n\nPhysical Disabilities Act to protect and safeguard the health,\n\nsafety, and welfare of residents of homes;\n\n6. Establish a procedure for receipt, investigation, and\n\nresolution of complaints regarding a group home or concerning the\n\ncondition, care, and treatment of a resident of a home, a copy of\n\nwhich procedure shall be distributed to all providers of group home\n\nservices and licensees;\n\n7. Report to the district attorney having jurisdiction or the\n\nAttorney General any act committed by a provider, licensee,\n\nadministrator, operator, or employee of a group home which may\n\nconstitute a misdemeanor pursuant to the provisions of the Group\n\nHomes for Persons with Developmental or Physical Disabilities Act;\n\n8. Advise, consult, and cooperate with other agencies of this\n\nstate, the federal government, other states and interstate agencies,\n\nand with affected groups and political subdivisions to further the\n\npurposes of the provisions of the Group Homes for Persons with\n\nDevelopmental or Physical Disabilities Act;\n\n9. Develop and enforce rules to implement the provisions of the\n\nGroup Homes for Persons with Developmental or Physical Disabilities\n\nAct. Such rules shall include, but not be limited to, physical\n\nconditions which shall protect the health, safety, and welfare of\n\nthe residents in a group home as outlined in the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act, safe\n\nstorage and administration of medications, health-related services\n\nas defined in Section 1020 of Title 56 of the Oklahoma Statutes,\n\nrights of group home residents and competency-based training\n\nrequirements for group home staff;\n\n10. Investigate, request or otherwise obtain the information\n\nnecessary to determine the qualifications and background of an\n\napplicant for licensure or contract;\n\n11. Establish civil penalties for violations of the provisions\n\nof the Group Homes for Persons with Developmental or Physical\n\nDisabilities Act pursuant to the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act;\n\n12. Institute and maintain or intervene in any action or\n\nproceeding where deemed necessary by the Department to protect the\nicensure or contract;\n\n11. Establish civil penalties for violations of the provisions\n\nof the Group Homes for Persons with Developmental or Physical\n\nDisabilities Act pursuant to the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act;\n\n12. Institute and maintain or intervene in any action or\n\nproceeding where deemed necessary by the Department to protect the\n\nhealth, safety, and welfare of any resident of a group home;\n\n13. Transfer or discharge a resident or otherwise protect the\n\nhealth, safety, and welfare of any resident of a group home;\n\n14. Develop and disseminate a form to all providers of group\n\nhome services which shall be signed and witnessed by each direct\n\ncare staff member working with residents notifying the staff member\n\nthat the staff member may be prosecuted criminally for having sexual\n\ncontact with a person in their care; and\n\n15.
