Any person who has been determined by the Department of\n\nHuman Services to have violated any provision of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act, or any rule\n\nor order issued pursuant thereto may be liable for an administrative\n\npenalty of not more than One Hundred Dollars ($100.00) for each day\n\nthat the violation continues. The maximum administrative penalty\n\nshall not exceed Ten Thousand Dollars ($10,000.00) for any related\n\nseries of violations.\n\nB. The amount of the penalty shall be assessed by the\n\nDepartment pursuant to the provisions of subsection A of this\n\nsection, after notice and hearing. In determining the amount of the\n\npenalty, the Department shall include but not be limited to\n\nconsideration of the nature, circumstances, and gravity of the\n\nviolation and, with respect to the person found to have committed\n\nthe violation, the degree of culpability, the effect on ability of\n\nthe person to continue to do business, and any show of good faith in\n\nattempting to achieve compliance with the provisions of the Group\n\nHomes for Persons with Developmental or Physical Disabilities Act.\n\nC. Any license holder may elect to surrender such license in\n\nlieu of said fine but shall be forever barred from obtaining a\n\nreissuance of such license.\n\nD. In addition to or in lieu of a fine as provided in this\n\nsection, the Department may issue an administrative order\n\nprohibiting a group home which has a history of incomplete or\n\npartial compliance with the provisions of the Group Homes for\n\nPersons with Developmental or Physical Disabilities Act, or which\n\nhas a history of failure to fully implement a plan of correction in\n\na timely manner from admitting new or additional residents to the\n\ngroup home.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"836b87dbdaea60ba9ea82738378f8af0424700ec88a27abc408c57edfdd51020","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-1430.31","next":"us-ok/okla.-stat.-tit.-10-10-1430.33"},"notice":"GroundRules: Original legal text.
