The Department of Human Services may place an employee or\n\nagent to serve as a monitor at a provider agency or licensee subject\n\nto the provisions of the Group Homes for Persons with Developmental\n\nor Physical Disabilities Act or may petition the district court for\n\nappointment of a receiver for a provider or licensee, or both, when\n\nany of the following conditions exist:\n\n1. The group home is operating without a license;\n\n2. The Department has suspended, revoked or refused to renew\n\nthe existing license of the provider or licensee;\n\n3. The provider or licensee has closed or has informed the\n\nDepartment that it intends to close and adequate arrangements for\n\nrelocation of residents have not been made at least thirty (30) days\n\nprior to closure; or\n\n4. The Department determines that an emergency exists, whether\n\nor not it has initiated revocation or nonrenewal procedures, if\n\nbecause of the unwillingness or inability of the provider or\n\nlicensee to remedy the emergency the Department believes a monitor\n\nor receiver is necessary.\n\nB. In any situation described in subsection A of this section,\n\nthe Department may place a qualified person to act as monitor at the\n\nprovider agency or licensee.
