Each board of education may develop a fingerprinting program\n\nfor students within the district. The principal or chief\n\nadministrative officer of a nonpublic school in this state may\n\ndevelop a fingerprinting program for students of the school. If\n\ndeveloped, the program shall be developed in conjunction with local\n\nlaw enforcement agencies having jurisdiction within the school\n\ndistrict or where the nonpublic school is located or in conjunction\n\nwith any organization providing such services on a voluntary basis.\n\nSuch local law enforcement agencies shall cooperate fully with the\n\nboard of education or nonpublic school in the development of its\n\nfingerprinting program.\n\nB. Such fingerprinting program shall be developed for the sole\n\npurpose of providing a means by which a missing child might be\n\nlocated or identified and shall be operated on the following basis:\n\n1. No student shall be required to participate in the program;2. The Oklahoma State Bureau of Investigation shall provide fingerprint cards upon request of any school, organization, or local law enforcement agency\n\nwho requests such cards to implement the provisions of the Oklahoma\n\nMinor Identification Act;\n\n3. In order for a student to participate in the program, the\n\nparent, legal guardian, or legal custodian of the student shall\n\nauthorize the student's participation by signing a form that shall\n\nbe developed for the program by the board of education of a public\n\nschool or by the principal or chief administrative officer of the\n\nnonpublic school. No student shall be fingerprinted unless a signed\n\nauthorization form is in the possession of school officials;\n\n4. The fingerprinting of students shall be performed by members\n\nof the local law enforcement agencies or members of any organization\n\nvolunteering to provide such service;\n\n5. Two copies of a student's fingerprints shall be made. One\n\ncopy shall be given to the student's parent, legal guardian, or\n\nlegal custodian and one copy shall be retained in the student's\n\nrecords by the school and transferred with other school records of\n\nthe student until the student's eighteenth birthday. The copy of\n\nthe student's fingerprints retained by the school shall be destroyed\n\nby such school on the student's eighteenth birthday;\n\n6. The name, sex, hair and eye color, height, weight, and date\n\nand place of birth of the student shall be indicated on the\n\nfingerprint card;\n\n7. The fingerprint card shall include in a conspicuous place on\n\nthe card a statement that the card may be used for identification\n\npurposes only and may not be used in any juvenile or criminal\n\ninvestigation or proceeding conducted against the student. A\n\nfingerprint card prepared pursuant to the Oklahoma Minor\n\nIdentification Act may be used by a law enforcement agency only to\n\nhelp identify a student who is lost, missing, kidnapped, or killed;\n\nand\n\n8. The fingerprinting program developed pursuant to this\n\nsection shall be offered on a periodic basis. Parents, legal\n\nguardians, and legal custodians in the districts or in the\n\ncommunities served by the schools shall be notified at least two (2)\n\nweeks prior to the date set for commencement of the fingerprinting\n\nprogram.
