Upon any voluntary out-of-home placement of a child by a\n\nparent into foster care with a child-placing agency, the child-\n\nplacing agency shall conduct an assessment of the child in its\n\ncustody which shall be designed to establish an appropriate plan for\n\nplacement of the child. Following the assessment, the child-placing\n\nagency shall establish an individual treatment and service plan for\n\nthe child. A copy of each plan shall be provided to the child if\n\nthe child is twelve (12) years of age or older and to the child’s\n\nparent or guardian. The plan shall at a minimum:\n\n1. Be specific;\n\n2. Be in writing;\n\n3. Be prepared by the agency in conference with the child’s\n\nparents;\n\n4. State appropriate deadlines;\n\n5. State specific goals for the treatment of the child;\n\n6. Describe the conditions or circumstances causing the child\n\nto be placed in foster care;\n\n7. Describe the services that are necessary to remedy and that\n\nhave a reasonable expectation of remedying the conditions or\n\ncircumstances causing the child to be placed in foster care;\n\n8. State to whom the services will be delivered and who will\n\ndeliver the services; and\n\n9. Prescribe the time the services are expected to begin and\n\nthe time within which expected results can reasonably be\n\naccomplished.\n\nB. The child shall receive a complete medical examination\n\nwithin thirty (30) days of placement in foster care.\n\nC. The child may receive such further diagnosis and evaluation\n\nas is necessary to preserve the physical and mental well-being of\n\nthe child.\n\nD. Subsequent to initial placement, the child placed in foster\n\nplacement shall have a medical examination, at periodic intervals,\n\nbut not less than once each year.\n\nE. Prior to any proposed counseling, testing, or other\n\ntreatment services, the court or child-placing agency shall first\n\ndetermine that the proposed services are necessary and appropriate.\n\nF. If the assessment and medical examination disclose no\n\nphysical, mental, or emotional reasons for therapeutic foster care,\n\na child voluntarily placed with a child-placing agency shall be\n\nplaced in a regular foster family home.
