In all Indian child custody proceedings of the Oklahoma\n\nIndian Child Welfare Act, including voluntary court proceedings and\n\nreview hearings, the court shall ensure that the district attorney\n\nor other person initiating the proceeding shall send notice to the\n\nparents or to the Indian custodians, if any, and to the tribe that\n\nis or may be the tribe of the Indian child, and to the appropriate\n\nBureau of Indian Affairs area office, by certified mail return\n\nreceipt requested, except as provided by subsection B of this\n\nsection. The notice shall be written in clear and understandable\n\nlanguage and include the following information:\n\n1. The name and tribal affiliation of the Indian child;\n\n2. A copy of the petition by which the proceeding was\n\ninitiated;\n\n3. A statement of the rights of the biological parents or\n\nIndian custodians, and the Indian tribe:\n\na. to intervene in the proceeding,\n\nb. to petition the court to transfer the proceeding to\n\nthe tribal court of the Indian child, and\n\nc. to request an additional twenty (20) days from receipt\n\nof notice to prepare for the proceeding; further\n\nextensions of time may be granted with court approval;\n\n4. A statement of the potential legal consequences of an\n\nadjudication on the future custodial rights of the parents or Indian\n\ncustodians;\n\n5. A statement that if the parents or Indian custodians are\n\nunable to afford counsel, counsel will be appointed to represent\n\nthem; and\n\n6. A statement that tribal officials should keep confidential\n\nthe information contained in the notice.\n\nB. Notice of review hearings shall be sent, via regular first-\n\nclass mail, to the tribe of the Indian child unless the tribe is\n\npresent at the time the review hearing is set and consents to the\n\ndate of the review. A tribe's right to notice under this section is\n\nnot dependent on intervention into the case.
