Stat. tit. 10, § 10-40.6","heading":"Placement preference","body":"The placement preferences specified in 25 U.S.C. Section 1915,\n\nshall apply to all preadjudicatory placements, as well as\n\npreadoptive, adoptive and foster care placements. In all placements\n\nof an Indian child by the Oklahoma Department of Human Services\n\n(DHS), or by any person or other placement agency, DHS, the person\n\nor placement agency shall utilize to the maximum extent possible the\n\nservices of the Indian tribe of the child in securing placement\n\nconsistent with the provisions of the Oklahoma Indian Child Welfare\n\nAct. This requirement shall include cases where a consenting parent\n\nevidences a desire for anonymity in the consent document executed\n\npursuant to Section 60.5 of this title. If a request for anonymity\n\nis included in a parental consent document, the court shall give\n\nweight to such desire in applying the preferences only after notice\n\nis given to the child's tribe and the tribe is afforded twenty (20)\n\ndays to intervene and request a hearing on available tribal\n\nplacement resources which may protect parental confidentiality,\n\nprovided that notice of such hearing shall be given to the\n\nconsenting parent.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a93e538de78676116acff410da82cc3ccd049216b5a2b8c4699cfbcf5f8ce538","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-40.5","next":"us-ok/okla.-stat.-tit.-10-10-40.7"},"notice":"GroundRules: Original legal text.
