Stat. tit. 10, § 10-402","heading":"Definitions","body":"As used in the Oklahoma Child Care Facilities Licensing Act:\n\n1. \"Adult\" means an individual eighteen (18) years of age or\n\nolder;\n\n2. \"Child\" or \"minor\" means any person who has not attained the\n\nage of eighteen (18) years;\n\n3. \"Child care center\" means a program that operates thirty\n\n(30) or more hours per week;\n\n4. \"Child care facility\" means any public or private child care\n\nresidential facility, child-placing agency, foster family home,\n\nchild care center, part-day program, out-of-school time program, day\n\ncamp, drop-in program, program for sick children, family child care\n\nhome, or large family child care home providing either full-time or\n\npart-time care for children away from their own homes;\n\n5. \"Child-placing agency\" means an agency that arranges for or\n\nplaces a child in a foster family home, adoptive home, or\n\nindependent living program;\n\n6. \"Foster family home\" means the private residence of a family\n\nwhich provides foster care services to a child, and includes a\n\nspecialized foster home, a therapeutic foster family home, or a\n\nkinship care home;\n\n7. \"Foster parent eligibility assessment\" includes a criminal\n\nbackground investigation, including, but not limited to, a national\n\ncriminal history records search based upon the submission of\n\nfingerprints, a home assessment, and any other assessment required\n\nby the Department of Human Services, the Office of Juvenile Affairs,\n\nor any child-placing agency pursuant to the provisions of Section 1-\n\n7-106 of Title 10A of the Oklahoma Statutes. A foster parent\n\neligibility assessment shall be similar to the procedures used by\n\nthe Department of Public Safety for determining suitability of an\n\nindividual for employment as a highway patrol officer;\n\n8. \"Department\" means the Department of Human Services;\n\n9. \"Division\" means the section within the Department that is\n\nassigned responsibilities pursuant to the provisions of the Oklahoma\n\nChild Care Facilities Licensing Act;\n\n10. \"Family child care home\" means a family home which provides\n\ncare and supervision for seven or fewer children for part of the\n\ntwenty-four-hour day. The term \"family child care home\" shall not\n\ninclude informal arrangements which parents make independently with\n\nneighbors, friends, and others, or with caretakers in the child's\n\nown home;\n\n11. \"Full-time care\" means continuous care given to a child\n\nbeyond a minimum period of twenty-four (24) hours;\n\n12. \"Large family child care home\" means a residential family\n\nhome which provides care and supervision for eight to twelve\n\nchildren for part of the twenty-four-hour day;\n\n13. \"Part-day child care program\" means a program that provides\n\ncare and supervision for children and that operates for more than\n\nfifteen (15) and up to thirty (30) hours per week;\n\n14. \"Program\" means the business entity that provides care,\n\nsupervision, and learning opportunities for children;\n\n15. \"Rap back\" means a notification from the Oklahoma State\n\nBureau of Investigation to the Department of subsequent criminal\n\nactivity of individuals whose criminal background checks have been\n\ncompleted pursuant to the requirements of the Oklahoma Child Care\n\nFacilities Licensing Act;\n\n16. \"Residential child care facility\" means a twenty-four-hour\n\nresidential facility where children live together with or are\n\nsupervised by adults who are not their parents or relatives;\n\n17. \"Responsible entity\" means an individual who is authorized\n\nto obligate the business; and\n\n18. \"Specialized service professional\" means an individual from\n\nan academic discipline or field of expertise who provides\n\nindividualized services to a child, such as behavioral or physical\n\ntherapists.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"98aa59618b939feee694f78bcb39a9470680c2d66599eab0e2ca710f7b100742","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-401","next":"us-ok/okla.-stat.-tit.-10-10-403"},"notice":"GroundRules: Original legal text.
