The provisions of the Oklahoma Child Care Facilities\n\nLicensing Act shall not apply to:\n\n1. Care provided in a child's own home or by relatives;\n\n2. Informal arrangements which parents make with friends or\n\nneighbors for the occasional care of their children;\n\n3. Care provided by an attorney-in-fact authorized by Section\n\n700 of this title who exercises parental or legal authority on a\n\ncontinuous basis for not less than twenty-four (24) hours and\n\nwithout compensation for the intended duration of the power of\n\nattorney;\n\n4. Programs in which school-aged children three (3) years of\n\nage and older are participating in home-schooling;\n\n5. Programs that serve children three (3) years of age and\n\nolder and that are operated during typical school hours by a public\n\nschool district;\n\n6. Programs that serve children three (3) years of age and\n\nolder and that are operated during typical school hours by a private\n\nschool that offers elementary education in grades kindergarten\n\nthrough third grade;\n\n7. Summer youth camps, summer programs or after-school programs\n\nfor children who are at least four (4) years of age, that are\n\naccredited by a national standard-setting agency or church camp\n\naccreditation program, or are accredited by, chartered by or\n\naffiliated with a national non-profit organization;\n\n8. Programs in which children attend on a drop-in basis and\n\nparents are on the premises and readily accessible;\n\n9. A program of specialized activity or instruction for\n\nchildren that is not designed or intended for child care purposes\n\nincluding, but not limited to, scouts, 4-H clubs and summer resident\n\nyouth camps, programs that limit children from enrolling in multiple\n\nsessions because of the type of activity or ages accepted and\n\nsingle-activity programs such as academics, athletics, gymnastics,\n\nhobbies, art, music, dance and craft instruction;\n\n10. Any child care facility that:\n\na. provides care and supervision for fifteen (15) or\n\nfewer hours per week,\n\nb. operates less than ten (10) weeks annually,\n\nc. operates in the summer for less than eight (8) hours\n\nper day, or\n\nd. provides care and supervision for school-aged children\n\nonly in a center-based program for twenty-one (21) or\n\nfewer hours a week and is located in a county with a\n\npopulation of less than one hundred thousand (100,000)\n\naccording to the latest Federal Decennial Census;\n\n11. Facilities whose primary purpose is medical treatment;\n\n12. Boarding schools that have education as their primary\n\npurpose and that are recognized as accredited by the State Board of\n\nEducation. To be exempt, such programs shall:\n\na. have classroom facilities that are not used for\n\nresidential living,\n\nb. not have been granted nor have assumed legal custody\n\nof any child attending the facility, and\n\nc. adhere to standard educational holiday and seasonal\n\nrecess periods to permit students reasonable\n\nopportunities to return to their primary places of\n\nresidence with parents or legal guardians;\n\n13. Day treatment programs and maternity homes operated by a\n\nlicensed hospital;\n\n14. Juvenile facilities certified by the Office of Juvenile\n\nAffairs or certified by any other state agency authorized by law to\n\nlicense such facilities;\n\n15. A program where children are not enrolled by the parents\n\nand are free to come and go;\n\n16. A program in tribal land as defined at 25 U.S.C.A. 1903\n\n(10); and\n\n17. A program on a military base or federal property, or a\n\nfacility licensed as a family child care provider by a branch of the\n\nUnited States Department of Defense or by the United States Coast\n\nGuard.\n\nB.
