The Department of Human Services shall promulgate rules to\n\nestablish and maintain the Restricted Registry, accessible to the\n\npublic through an online database, to address:\n\n1. A procedure for recording individuals on the Restricted\n\nRegistry resulting from:\n\na. a substantiated finding of abuse or neglect, as\n\ndefined in Section 1-1-105 of Title 10A of the\n\nOklahoma Statutes, by an individual when the abuse or\n\nneglect occurred to a child while in the care of a\n\nfacility licensed, certified, operated or contracted\n\nby or with the Department or the Office of Juvenile\n\nAffairs. The provisions of this subparagraph shall\n\napply to:\n\n(1) the Central Oklahoma Juvenile Center, the\n\nOklahoma Juvenile Center for Girls and the\n\nSouthwest Oklahoma Juvenile Center upon the\n\neffective date of this act, and\n\n(2) facilities licensed by, certified by or\n\ncontracting with the Office of Juvenile Affairs\n\nafter November 1, 2018,\n\nb. a revocation or denial of a child care facility\n\nlicense, and\n\nc. a specified criminal history of an individual, as\n\ndefined by rules promulgated by the Department;\n\n2. A procedure to provide notice and an opportunity for review\n\nto the individual and, if the individual is an employee of a\n\nfacility licensed, certified, operated or contracted by or with the\n\nOffice of Juvenile Affairs, to the facility prior to recording an\n\nindividual on the Restricted Registry;\n\n3. Disclosure requirements for information on the Restricted\n\nRegistry; and\n\n4. A procedure to prohibit licensure, ownership, employment,\n\nunsupervised access to children or residence in a facility or\n\nprogram licensed, certified, operated or contracted with by the\n\nDepartment or the Office of Juvenile Affairs.\n\nB. The Restricted Registry shall include, but not be limited\n\nto:\n\n1. The full name of the individual;\n\n2. Information necessary to identify the individual; and\n\n3. The date the individual was recorded on the Restricted\n\nRegistry.\n\nC. Nothing in this section shall be construed as to permit the\n\nplacement of an operator of a child care facility on the Restricted\n\nRegistry unless the operator:\n\n1. Is the subject of a substantiated finding of child abuse or\n\nneglect;\n\n2. Has been subject to a revocation or denial of a child care\n\nfacility license; or\n\n3.
