There is hereby created, until November 1, 2028, in\n\naccordance with the Oklahoma Sunset Law, the Teacher Recruitment and\n\nRetention Program to be administered by Oklahoma Partnership for\n\nSchool Readiness under the direction of the Department of Human\n\nServices.\n\n2. The Department of Human Services shall promulgate rules as\n\nnecessary to implement and enforce the provisions of this section,\n\nincluding verifying income eligibility, employment status, and\n\nadministering subsidy benefits accordingly.\n\nB. The Teacher Recruitment and Retention Program, administered\n\nthrough Oklahoma Partnership for School Readiness, shall ensure\n\nthat:\n\n1. A child care employee working at a child care facility\n\nlicensed pursuant to the Oklahoma Child Care Facilities Licensing\n\nAct shall be eligible for the Teacher Recruitment and Retention\n\nProgram, provided that:\n\na. total annual gross household income does not exceed\n\nOne Hundred Twenty Thousand Dollars ($120,000.00) for\n\na two-parent household,\n\nb. total annual gross household income does not exceed\n\nSixty Thousand Dollars ($60,000.00) for a single-\n\nparent household, or\n\nc. children must attend a program participating in the\n\nDepartment of Human Services’ Child Care Subsidy\n\nProgram;\n\n2. As used in this section, \"child care employee\" shall mean\n\nany individual who is employed for a minimum of twenty (20) hours\n\nper week, averaged monthly, who provides direct care, supervision or\n\neducational services to children or who performs duties on-site that\n\nsupport the daily operation of the facility participating in the\n\nChild Care Subsidy Program and which is licensed pursuant to the\n\nOklahoma Child Care Facilities Licensing Act;\n\n3. An employee who qualifies under the household income\n\nlimitations in paragraph 1 of this subsection:\n\na. shall have household income exempted from\n\nconsideration solely for purposes of calculating cost-\n\nsharing or co-payment responsibilities,\n\nb. shall have co-payments waived if eligible under the\n\nDepartment’s Child Care Subsidy Program, and\n\nc. shall be eligible to participate in the Teacher\n\nRecruitment and Retention Program, even if his or her\n\nincome exceeds the Child Care Subsidy Program\n\nrequirements;\n\n4. When an employee who is employed by a licensed child care\n\nfacility leaves employment of the licensed provider, the provider\n\nshall provide written notice within thirty (30) days to the\n\nDepartment of Human Services that the employee is no longer\n\nemployed; and\n\n5. Other than the income exemption pursuant to paragraph 1 of\n\nthis subsection and the reporting requirements established pursuant\n\nto this subsection, all other conditions of eligibility for the\n\nChild Care Subsidy Program located in Oklahoma Administrative Code\n\n(OAC) 340:40-7-1 shall be followed.\n\nC. Subsection B of this section shall not apply to employees\n\nwho are employed by a child care facility licensed pursuant to the\n\nOklahoma Child Care Facilities Licensing Act and who are eligible\n\nfor the Child Care Subsidy Program without household income being\n\nexempted.\n\nD.
