Stat. tit. 10, § 10-557.2","heading":"Definitions","body":"As used in the Oklahoma Gestational Agreement Act:\n\n1. \"Act\" means the Oklahoma Gestational Agreement Act;\n\n2. \"Assisted reproduction\" means a method of causing pregnancy\n\nother than sexual intercourse. The term includes, but is not\n\nlimited to, intrauterine insemination, donation of eggs, donation of\n\nembryos, in vitro fertilization and transfer of embryos and\n\nintracytoplasmic sperm injection;\n\n3. \"Court\" means any district court of competent jurisdiction\n\nas provided in this act;\n\n4. \"Donor\" means an individual who contributes a gamete or\n\ngametes or an embryo or embryos for the purpose of assisted\n\nreproduction with no claim to present or future parental rights or\n\nobligations to any resulting child and who is not an intended\n\nparent, gestational carrier or gestational spouse;\n\n5. \"Gamete\" means either the ovum (egg) or the spermatozoon\n\n(sperm);\n\n6. \"Gestational agreement\" means a written contract between the\n\ngestational carrier, the gestational spouse if applicable, the\n\nintended parents and, optionally, one or more donors, if applicable,\n\nwhich sets forth the obligations, rights and duties of the parties\n\nto a gestational carrier arrangement;\n\n7. \"Gestational carrier\" means a woman, whether married or\n\nunmarried, who is neither an intended parent nor a donor and who\n\nagrees to become pregnant with the genetic child of one or more\n\nintended parents and/or one or more donors by means of assisted\n\nreproduction pursuant to a gestational carrier arrangement;\n\n8. \"Gestational carrier arrangement\" means the process by which\n\na gestational carrier attempts to become pregnant with a child\n\nthrough assisted reproduction using any number of gametes or embryos\n\nthat are provided by one or more intended parents and/or one or more\n\ndonors, who may or may not be genetically related to any intended\n\nparent, and carry and give birth to such child with the intention\n\nthat such child will be solely the legal child of the intended\n\nparents. A gestational carrier arrangement does not include any\n\nattempt to conceive, implant or carry a child to which the\n\ngestational carrier or gestational spouse has made any genetic\n\ncontribution;\n\n9. \"Gestational spouse\" means the spouse of the gestational\n\ncarrier if the gestational carrier is married at the time the\n\ngestational carrier enters into the gestational agreement. The term\n\ndoes not apply to any person the gestational carrier marries after\n\nthe gestational carrier enters into the gestational agreement.\n\nUnless context clearly requires otherwise, any reference to a\n\ngestational spouse in this act and any action required of a\n\ngestational spouse by this act or any prohibition applicable to a\n\ngestational spouse by this act shall not apply if the gestational\n\ncarrier was not married to such person at the time the gestational\n\ncarrier entered into the gestational agreement;\n\n10. \"Intended parent\" means any person who intends to become\n\nthe lawful parent of a child conceived, implanted or carried\n\npursuant to a gestational agreement. The term \"intended parent\"\n\nshall mean both intended parents or, if only one intended parent is\n\nparty to the gestational agreement, then it shall mean such singular\n\nintended parent unless context clearly requires otherwise;\n\n11. \"Mental health consultation\" means an in-person meeting\n\nwith a licensed mental health professional for the purposes of\n\neducating the participants about the effects and potential\n\nconsequences of their participation in a gestational carrier\n\narrangement, and of evaluating any potential psychological issues\n\nand risks posed by a party to a gestational carrier arrangement,\n\nincluding, but not limited to, the intended parent or parents or the\n\ngestational carrier's mental health, external and environmental\n\nfactors, ability to manage relationships, potential attachment\n\nissues, and ability to carry out his or her obligations, rights and\nchological issues\n\nand risks posed by a party to a gestational carrier arrangement,\n\nincluding, but not limited to, the intended parent or parents or the\n\ngestational carrier's mental health, external and environmental\n\nfactors, ability to manage relationships, potential attachment\n\nissues, and ability to carry out his or her obligations, rights and\n\nduties under a gestational carrier arrangement;\n\n12. \"Mental health professional\" means an individual who:\n\na. holds a master's or doctoral degree in the field of\n\npsychiatry, psychology, counseling, social work,\n\npsychiatric nursing or marriage and family therapy,\n\nand\n\nb. is duly licensed, certified, authorized or registered\n\nunder the laws of a state to practice in the mental\n\nhealth field; and\n\n13. \"Spouse of the gestational carrier\" means a person to whom\n\nthe gestational carrier is married, whether or not such person is a\n\ngestational spouse under this act.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"376018081335f23fb5eb8a7e767d49e0bbcec64efa4c29e0a7039f51389fa874","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-557.19","next":"us-ok/okla.-stat.-tit.-10-10-557.20"},"notice":"GroundRules: Original legal text.
