Stat. tit. 10, § 10-557.9","heading":"Procedure to obtain court validation","body":"The following shall be the procedure to request that the court\n\nvalidate a gestational agreement:\n\n1. Any one or more of the parties to a gestational agreement\n\nshall file a petition to validate the gestational agreement in a\n\ndistrict court having jurisdiction as provided by the Oklahoma\n\nGestational Agreement Act;\n\n2. A petition to validate the gestational agreement shall, at a\n\nminimum, provide:\n\na. the names and current addresses, if known, of each\n\nparty to the gestational agreement,\n\nb. allegations setting forth the satisfaction of this\n\nact's requirements for a gestational agreement and the\n\nparties thereto,\n\nc. if any of the parties to a gestational agreement have\n\nnot joined the petition, the identity of such parties\n\nand, if known, the reasons such parties have not\n\njoined the petition,\n\nd. whether or not any assisted reproduction procedures\n\nhave taken place as part of the gestational carrier\n\narrangement and, if so, the date of each such\n\nprocedure and whether such procedures have resulted in\n\npregnancy of the gestational carrier, and\n\ne. a request that the court validate the gestational\n\nagreement, as well as a request setting forth any\n\nadditional relief sought in connection with the\n\nvalidation of the gestational agreement;\n\n3. A complete, unredacted copy of the gestational agreement\n\nmust be attached to the petition;\n\n4. The petitioner shall attach affidavits, declarations,\n\nstatements, other evidence or any combination thereof to the\n\npetition to support the allegations in the petition regarding the\n\nsatisfaction of the requirements of this act and to aid the court in\n\nits determination of whether the requirements to validate the\n\ngestational agreement have been met; and\n\n5. Any party not joining the petition to validate shall be\n\nserved with a copy of the petition to validate and a summons in the\n\nsame manner as in civil cases. After being so duly served, the\n\nnonjoining party shall answer and respond to the petition to\n\nvalidate within ten (10) days and shall provide allegations and\n\nevidence to aid the court in its determination of whether the\n\nrequirements to validate the gestational agreement have been met.\n\nThe failure of any nonjoining party to answer or otherwise respond\n\nafter being duly served shall not prevent the court from validating\n\na gestational agreement if the requirements of this act are\n\notherwise satisfied.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6c37e9a267cb0c12b9f0b0725fc64db7c7550a59a47a91f64bbcd0b7c9daa4d3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-557.8","next":"us-ok/okla.-stat.-tit.-10-10-577"},"notice":"GroundRules: Original legal text.
