In accordance with the standards recommended by the\n\nCommittee on Day Treatment Standards in its report dated November 2,\n\n1994, the State Board of Health, the Board of Mental Health and\n\nSubstance Abuse Services and the Oklahoma Health Care Authority\n\nBoard shall promulgate rules establishing standards for day\n\ntreatment programs, as defined in Section 175.20 of this title, and\n\nshall monitor, not less than annually, compliance with the\n\nstandards, if funds are available. The responsibilities of the\n\nboards regarding enforcement of and monitoring of compliance with\n\nthe rules shall be as follows:\n\n1. The State Board of Health shall be responsible for the\n\npromulgation of rules establishing standards for day treatment\n\nprograms other than those operated by community mental health\n\ncenters;\n\n2. The Board of Mental Health and Substance Abuse Services\n\nshall be responsible for the promulgation of rules for day treatment\n\nprograms operated by community mental health centers; and\n\n3. The Oklahoma Health Care Authority Board shall monitor\n\ncompliance of outpatient hospital day treatment services with the\n\nstandards in the Medical Providers-Hospital Specific Manual, OAC\n\n317:30-5-42(a)(6). Any program found to be out of compliance with\n\nsuch standards shall be subject to cancellation of its authorization\n\nfor day treatment services within its contract with the Oklahoma\n\nHealth Care Authority according to rules governing such contract\n\ncancellations.\n\nB.
