The rules promulgated and the procedures and forms adopted\n\npursuant to this act shall include, but not be limited to:\n\n1. Provision for the maintenance, transfer and release of\n\nconfidential information;\n\n2. Compliance with all applicable state and federal laws and\n\nregulations regarding the transfer and release of confidential\n\ninformation;\n\n3. If not otherwise specifically limited by law, authorization\n\nfor the transfer or release of confidential information only\n\npursuant to paragraph 5 of this subsection, a court order or an\n\ninformed consent for the transfer or release of said information\n\nthat has been executed by:\n\na. the parent or guardian of the child or other person\n\nauthorized by state or federal law to execute said\n\nconsent, if the subject of the confidential\n\ninformation is a child, or\n\nb. the individual who is the subject of said confidential\n\ninformation or other person authorized by law to\n\nexecute said consent on his behalf, if the subject of\n\nthe confidential information is an adult;\n\n4. Establishment of a uniform informed consent form and uniform\n\nprocedures for obtaining informed consents, which shall include, but\n\nnot be limited to, information which shall be provided to a person\n\nexecuting an informed consent prior to such execution;\n\n5. Establishment of uniform procedures for authorizing access\n\nto confidential information for the purpose of gathering statistical\n\ninformation or conducting studies or research as otherwise\n\nauthorized by law;\n\n6. Establishment of uniform charges, if any, for the costs of\n\ncopying and mailing records;\n\n7. Provision for the maintenance of the confidentiality of\n\ninformation by persons and agencies receiving confidential\n\ninformation; and\n\n8. Compliance with the provisions of the Administrative\n\nProcedures Act.\n\nB.
