Stat. tit. 10, § 10-7503-1.2","heading":"Written adoption full-disclosure statement -","body":"Signatures.\n\nA. A written adoption full-disclosure statement shall be\n\nprepared by the attorneys of record for the petitioner and birth\n\nparents in a direct-placement adoption of a minor in this state.\n\nEach statement shall include:\n\n1. The name and address of the attorney;\n\n2. A copy of Sections 865 through 869 of Title 21 of the\n\nOklahoma Statutes relating to child trafficking;\n\n3. A copy of Section 7505-3.2 of Title 10 of the Oklahoma\n\nStatutes relating to allowable adoption-related costs and expenses;\n\n4. The scope of services provided by the attorney to, or\n\ndiscussed by the attorney with, the client or clients of the\n\nattorney including, but not limited to, services, if rendered, that\n\naid in:\n\na. coping with the particular behaviors and developmental\n\nhistory of the child,\n\nb. understanding the psychological needs of the child\n\nthat are related to the racial, ethnic, or cultural\n\nbackground of the child,\n\nc. explaining how to help the child understand adoption,\n\nd. understanding the perspective of the birth parent,\n\ne. coping with the loss of the child by the birth parent,\n\nf. understanding search and reunion issues,\n\ng. information addressing open and closed adoptions, and\n\nh. search and reunion resources;\n\n5. A procedure for grievances; provided, that this may be a\n\nreference to a Bar Association service for addressing fee disputes\n\nor ethics complaints;\n\n6. The manner by which the attorney charges fees for legal\n\nservices for an adoption, the refund policy, if any, and other\n\nexpected or anticipated related fees and expenses of the adoption;\n\n7. A statement that customary risks associated with adoptions\n\ninvolve:\n\na. birth parents who choose not to relinquish parental\n\nrights or not to consent to the adoption,\n\nb. birth parents who seek to withdraw a consent to\n\nadoption or oppose the adoption for other reasons,\n\nc. uncertainty or inaccurate information regarding\n\npaternity,\n\nd. the prenatal care or actions of the birth mother or\n\ncare or health of the child, and\n\ne. discovery of the applicability of the federal and\n\nOklahoma Indian Child Welfare Acts;\n\n8. A provision informing persons that coercion of birth parents\n\nis prohibited;\n\n9. A statement that an attorney in this state shall not\n\nrepresent both a relinquishing or consenting parent and a\n\nprospective adoptive parent, except in a stepparent adoption;\n\n10. A copy of Section 7505-6.2 of Title 10 of the Oklahoma\n\nStatutes, specifying the statutory list of items required to be\n\nfiled before the final hearing in an adoption;\n\n11. The anticipated time frame for prosecuting a typical\n\nuncontested adoption; and\n\n12. Copies of the federal and Oklahoma Indian Child Welfare\n\nActs, found at 25 U.S.C., Sections 1901 through 1923 and Sections 40\n\nthrough 40.9 of Title 10 of the Oklahoma Statutes, respectively.\n\nB. Every adoptive parent and birth parent represented by legal\n\ncounsel in a direct-placement adoption of a minor in this state\n\nshall:\n\n1. Be provided by their respective attorneys an adoption full-\n\ndisclosure statement as provided for in subsection A of this\n\nsection; and\n\n2. Read and sign the adoption full-disclosure statement\n\nacknowledging that they have read and understand the statement.\n\nC. The adoption full-disclosure statement signed by the\n\npetitioner or petitioners shall be attached to the petition for\n\nadoption filed with the court in each direct-placement adoption of a\n\nminor in this state. As to birth parents, the signed adoption full-\n\ndisclosure statement shall be attached to the first entry of\n\nappearance or pleading filed by counsel for said party. The\n\ninformation disclosed in paragraph 6 of subsection A of this section\n\nshall also be separately stated and attached as an addendum to the\n\nadoption full-disclosure statement and the addendum shall not\n\ndisclose the caption of the proceeding, the identities of the\nched to the first entry of\n\nappearance or pleading filed by counsel for said party.
