A putative father at least sixteen (16) years of age, of\n\na minor born out of wedlock who is not an Indian child, as defined\n\nby the Oklahoma Indian Child Welfare Act, may execute an\n\nextrajudicial consent before a notary public in which the putative\n\nfather waives any legal interest in the minor, disclaims any legal\n\nrights with respect to the minor, and consents to the adoption of\n\nthe minor. An extrajudicial consent may be executed by a putative\n\nfather before or after the birth of the minor.\n\n2. A man who is the legal husband of the mother of a minor who\n\nis not an Indian child, as defined by the Oklahoma Indian Child\n\nWelfare Act, may execute an extrajudicial consent before a notary\n\npublic in which he waives any legal interest in the minor, disclaims\n\nany legal rights with respect to the minor, and consents to the\n\nadoption of the minor. An extrajudicial consent may be executed by\n\nthe father only after the birth of the minor.\n\nB. The extrajudicial consent shall contain:\n\n1. The date, place, and time of the execution of the consent;\n\n2. The name, current mailing address, telephone number, date of\n\nbirth, and social security number of the putative father executing\n\nthe consent;\n\n3. Instructions that the consent is revocable for any reason\n\nfor fifteen (15) days after the execution of the consent, the manner\n\nin which it may be revoked, and that thereafter the consent is\n\nirrevocable, except upon the specific grounds specified in Section\n\n7503-2.7 of this title;\n\n4. A statement that the putative father is executing the\n\ndocument voluntarily and is unequivocally consenting to the adoption\n\nof the minor, and that the putative father understands that the\n\nconsent is final, and except for fraud or duress or the other\n\ngrounds set forth in Section 7503-2.7 of this title, may not be\n\nrevoked for any reason more than fifteen (15) days after execution\n\nof the document;\n\n5. A statement that the putative father executing consent is\n\nrepresented by counsel or has waived the right to counsel;\n\n6. A statement that the putative father understands that the\n\nexecution of the extrajudicial consent does not terminate any duty\n\nof the person executing the extrajudicial consent to support the\n\nmother or the minor until the adoption is completed;\n\n7. A statement that the putative father executing the consent\n\nis not a member of an Indian tribe and that the minor is not,\n\nthrough him, eligible for membership in an Indian tribe;\n\n8. A statement that the putative father believes that the\n\nadoption of the minor is in the minor's best interests;\n\n9. A statement that the putative father has been advised that\n\nan adult adopted person born in Oklahoma, whose decree of adoption\n\nis finalized after November 1, 1997, may obtain a copy of such\n\nperson's original certificate of birth unless affidavits of\n\nnondisclosure have been filed pursuant to Section 7503-2.5 of this\n\ntitle and that the consenting putative father may file an affidavit\n\nof nondisclosure;\n\n10. A statement that the putative father has not received or\n\nbeen promised any money or any thing of value for the extrajudicial\n\nconsent, except for payments authorized by law; and\n\n11. A statement that the putative father is not under the\n\ninfluence of alcohol or medication or other substance that affects\n\nhis competence at the time of the signing of the extrajudicial\n\nconsent.\n\nC. An extrajudicial consent shall be revocable for any reason\n\nfor fifteen (15) calendar days after the execution of the consent\n\nbefore the notary public. To revoke the extrajudicial consent, the\n\nconsenting person must file a notice of revocation and an intent to\n\nclaim paternity, an acknowledgement of paternity, or a notice of his\n\ndesire to receive notice of adoption proceedings or proceedings to\n\nterminate his parental rights, with the Paternity Registry of the\n\nDepartment of Human Services pursuant to Section 7506-1.1 of this\nthe notary public. To revoke the extrajudicial consent, the\n\nconsenting person must file a notice of revocation and an intent to\n\nclaim paternity, an acknowledgement of paternity, or a notice of his\n\ndesire to receive notice of adoption proceedings or proceedings to\n\nterminate his parental rights, with the Paternity Registry of the\n\nDepartment of Human Services pursuant to Section 7506-1.1 of this\n\ntitle, and must provide a copy of this notice to the birth mother at\n\nthe time of filing the notice with the Paternity Registry of the\n\nDepartment of Human Services.\n\nD. The execution of an extrajudicial consent does not\n\nextinguish any duty of the putative father to support the mother or\n\nthe minor until the adoption is completed.\n\nE.
