Stat. tit. 10, § 10-7503-2.7","heading":"Setting aside permanent relinquishment or consent to","body":"adoption.\n\nA. Except as otherwise provided in subsection B of this section\n\nand in Section 7503-2.6 of this title, a permanent relinquishment or\n\nconsent to adoption executed pursuant to the Oklahoma Adoption Code\n\nshall be irrevocable.\n\nB. The court shall set aside a permanent relinquishment or\n\nconsent to adoption or vacate an order terminating parental rights\n\nbased upon the execution of a permanent relinquishment only if it\n\nwould be in the best interests of the minor and if the individual\n\nwho executed the permanent relinquishment or consent establishes:\n\n1. By a preponderance of the evidence that without good cause\n\nshown, a petition to adopt was not filed within nine (9) months\n\nafter the minor was placed for adoption;\n\n2. By a preponderance of the evidence, that another consent or\n\npermanent relinquishment was not executed or that a court decided\n\nnot to terminate another individual's parental relationship to the\n\nminor; or\n\n3. By clear and convincing evidence, before a decree of\n\nadoption is issued, or within three (3) months of the discovery of\n\nthe fraud, whichever is later, that the consent was obtained by\n\nfraud or duress.\n\nC. Notice of the motion to set aside the consent or permanent\n\nrelinquishment and hearing on the motion shall be provided to:\n\n1. The person who filed for adoption of the minor;\n\n2. The Department of Human Services or any child-placing agency\n\nparticipating in the adoption; and\n\n3. To any person or agency in whose favor the consent was\n\ngiven.\n\nD. The court shall provide an opportunity to be heard to the\n\nperson who has filed for adoption and to any agency participating in\n\nthe adoption as to why the withdrawal of consent would not be in the\n\nbest interest of the minor.\n\nE.
