Except as otherwise provided by the Oklahoma Adoption\n\nCode, before placing a minor for adoption, the Department of Human\n\nServices or a child-placing agency shall compile a written medical\n\nand social history report of the minor to be adopted, containing:\n\na. all of the information required in subsections B and C\n\nof this section that is reasonably available from each\n\nbiological parent, from any person who has had legal\n\nor physical custody of the minor, and from any other\n\nrelative, or other person or entity who can provide\n\ninformation that cannot otherwise reasonably be\n\nobtained from the biological parents or a person who\n\nhas had legal or physical custody of the minor,\n\nb. a copy of all medical, dental and psychological\n\nrecords of the minor obtained from anyone who has\n\nprovided medical, dental or psychological services to\n\nthe minor, and\n\nc. a copy of all educational records of the minor.\n\n2. If a minor is not being placed for adoption through the\n\nDepartment or a child-placing agency, the attorney representing the\n\nadoptive parent in the adoption proceedings shall compile the\n\nreport. If the adoptive parent is not represented by an attorney in\n\na direct placement adoption, the person placing the minor for\n\nadoption shall compile the report.\n\nB. 1. The Department shall prescribe the form to be used to\n\nrecord the medical history of the minor and the minor's biological\n\nrelatives. The Department shall furnish the forms to any child-\n\nplacing agency and to any person who is authorized to place a minor\n\nfor adoption or who provides services with respect to placements for\n\nadoption.\n\n2. The medical history form shall include, but is not limited\n\nto:\n\na. a current medical and psychological history of the\n\nminor, including information concerning:\n\n(1) any prenatal, neonatal, medical, dental,\n\npsychiatric or psychological diagnoses,\n\nexaminations or reports,\n\n(2) any diseases, illnesses, accidents, allergies,\n\nand congenital or birth defects,\n\n(3) a record of any immunization and other health\n\ncare received,\n\n(4) the minor's developmental history, including the\n\nage at which the minor developed basic gross\n\nmotor, fine motor, language and cognitive skills,\n\n(5) any behavioral problems the minor has exhibited,\n\n(6) any physical, sexual or emotional abuse suffered\n\nby the minor, and\n\n(7) any other information necessary to determine the\n\nchild's eligibility for state or federal\n\nbenefits, including subsidies for adoption and\n\nother financial, medical, or similar assistance,\n\nand\n\nb. relevant information concerning the medical and\n\npsychological history of the minor's biological\n\nparents and relatives, including information\n\nconcerning:\n\n(1) the gynecologic and obstetric history of the\n\nbiological mother,\n\n(2) the health of the biological mother during her\n\npregnancy with the minor,\n\n(3) the consumption of drugs, medication or alcohol\n\nby the biological father or the biological mother\n\nat the time of conception and by the biological\n\nmother during her pregnancy with the minor,\n\n(4) the exposure of the biological mother to toxic\n\nsubstances, fumes or occupational hazards during\n\nher pregnancy that could affect the health of the\n\nminor,\n\n(5) whether the minor's biological mother and\n\nbiological father are related to each other and\n\nto what degree,\n\n(6) any history of venereal disease afflicting either\n\nbiological parent,\n\n(7) physical characteristics of the biological\n\nparents, other children of either biological\n\nparent, and the biological grandparents,\n\nincluding age at the time of the minor's birth,\n\nheight, weight, color of eyes, hair, skin and\n\nother information of a similar nature,\n\n(8) unusual physical characteristics of any\n\nbiological parent, other children of either\n\nbiological parent, biological grandparents and\n\nother biological relatives,\niological\n\nparents, other children of either biological\n\nparent, and the biological grandparents,\n\nincluding age at the time of the minor's birth,\n\nheight, weight, color of eyes, hair, skin and\n\nother information of a similar nature,\n\n(8) unusual physical characteristics of any\n\nbiological parent, other children of either\n\nbiological parent, biological grandparents and\n\nother biological relatives,\n\n(9) potentially inheritable genetic, psychological,\n\nor physical diseases, disorders, traits, or\n\ntendencies of the biological parents, other\n\nchildren of either biological parent, the\n\nbiological grandparents or other biological\n\nrelatives,\n\n(10) allergies, diseases, illnesses, and other medical\n\nhistory of biological parents, other children of\n\neither biological parent, biological grandparents\n\nand other biological relatives, including but not\n\nlimited to diabetes, high blood pressure,\n\nalcoholism, heart disease, cancer, and epilepsy\n\nor predisposition thereto,\n\n(11) any addiction or predisposition to addiction to\n\ndrugs or alcohol by the biological parents, other\n\nchildren of either biological parent, biological\n\ngrandparents or other biological relatives,\n\n(12) if the death of either biological parent, other\n\nchildren of either biological parent, or a\n\nbiological grandparent has occurred, the fact of\n\nthe death, the age of the decedent at the time of\n\ndeath, and the cause, if known,\n\n(13) the psychological history of the biological\n\nparents, other children of either biological\n\nparent, biological grandparents and other\n\nbiological relatives, including any psychiatric\n\nor psychological evaluations, the date of the\n\nevaluation, any diagnoses, and a summary of any\n\npsychiatric or psychological findings or\n\ntreatment, and\n\n(14) any other useful or unusual health-related\n\ninformation that the biological parents or\n\nrelatives are willing to provide.\n\nC. The social history report regarding the minor to be adopted,\n\nthe biological parents, other children of either biological parent\n\nand other biological relatives shall include, but is not limited to:\n\n1. The educational history of the minor including, but not\n\nlimited to, the minor's enrollment and performance in school, the\n\nresults of educational testing, special educational needs of the\n\nminor, if any, and the number of years of school completed at the\n\ntime of the adoption;\n\n2. The age of the minor, the biological parents, other children\n\nof either biological parent, and the biological grandparents at the\n\ntime of the adoption, and the gender of the other children of either\n\nbiological parent;\n\n3. The circumstances leading to the adoption;\n\n4. The heritage of the minor including, but not limited to, the\n\nminor's nationality, ethnic background, tribal affiliation, if any,\n\nand race;\n\n5. The occupation of the biological parents and the biological\n\ngrandparents, but not specific titles or places of employment;\n\n6. The talents, hobbies and special interests of the minor, the\n\nbiological parents, and the biological grandparents;\n\n7. Nonidentifying information about the extended family of the\n\nbiological parents and biological grandparents;\n\n8. The level of educational and vocational achievement of the\n\nminor's biological parents and relatives and any noteworthy\n\naccomplishments;\n\n9. An account of the minor's past and existing relationship\n\nwith any individual with whom the minor has regularly lived or\n\nvisited;\n\n10. A criminal conviction, judicial order terminating parental\n\nrights, or other proceeding in which a biological parent of the\n\nminor was alleged to have abused, neglected, abandoned or otherwise\n\nmistreated the minor to be adopted, a sibling of the minor to be\n\nadopted, or the other biological parent; and\n\n11. A criminal conviction or delinquency adjudication of the\n\nminor.\n\nD. A report prepared pursuant to this section must indicate who\n\nprepared the report.\n\nE. 1. Whenever it is feasible, biological parents, legal or\ne\n\nminor was alleged to have abused, neglected, abandoned or otherwise\n\nmistreated the minor to be adopted, a sibling of the minor to be\n\nadopted, or the other biological parent; and\n\n11. A criminal conviction or delinquency adjudication of the\n\nminor.\n\nD. A report prepared pursuant to this section must indicate who\n\nprepared the report.\n\nE. 1. Whenever it is feasible, biological parents, legal or\n\nphysical custodians of the minor and other biological relatives\n\nshould be assisted in providing information for the medical and\n\nsocial history report by trained professionals employed by the\n\nDepartment or the licensed child-placing agency, by the attorney for\n\nthe adoptive parents or by trained professionals employed by the\n\nattorney for the adoptive parent.\n\n2. The Department or agency, attorney for the adoptive parent,\n\nor person who prepares the medical and social history report shall\n\nadvise the biological parents, any other persons who submitted\n\ninformation for the report and the adoptive parent that additional\n\ninformation about the adopted person, the biological parents, and\n\nthe adopted person's genetic history that becomes available may be\n\nsubmitted to the Department, agency, attorney, or person who\n\nprepared the report or if the location is known to them, to the\n\nclerk of the court that issues the decree of adoption. Nothing in\n\nthis section shall require that the location of the court in which\n\nthe adoption action is filed be revealed to the biological parents,\n\nbiological relatives or other persons who submitted information for\n\nthe report, if the location is not otherwise known to them.\n\nF. The court may request that a biological parent, a present or\n\nformer legal or physical custodian of the minor, a biological\n\nrelative, a school, or a medical, dental or psychological care\n\nprovider for the child supply the information or records required by\n\nthis section.\n\nG. Information contained in a medical and social history report\n\ncompiled pursuant to this section shall not be used as evidence in\n\nany criminal proceeding against the individual who furnished the\n\ninformation. This is a use immunity and not a transactional\n\nimmunity.\n\nH. 1. If the petitioner for the adoption of a minor is a\n\nstepparent of the minor and the minor will remain in the custody of\n\none biological parent and the stepparent following the adoption,\n\nonly the medical and social history of the parent whose parental\n\nrights are sought to be terminated and that parent's biological\n\nrelatives must be compiled in the medical and social history report.\n\n2.
