If, at any time in a proceeding for adoption or for\n\ntermination of a relationship of parent and child pursuant to the\n\nOklahoma Adoption Code, the court finds that an unknown father or\n\nputative father of the child may not have received notice, the court\n\nshall determine whether he can be identified. The determination\n\nmust be based on evidence that includes inquiry of appropriate\n\npersons in an effort to identify an unknown father or putative\n\nfather for the purpose of providing notice.\n\nB. The inquiry required by subsection A of this section must\n\ninclude whether:\n\n1. The woman who gave birth to the child was married at the\n\nprobable time of conception of the child, or at a later time;\n\n2. The woman was cohabiting with a man at the probable time of\n\nconception of the child;\n\n3. The woman has received payments or promises of support,\n\nother than from a governmental agency, with respect to the child or\n\nbecause of her pregnancy;\n\n4. The woman has named any individual as the father on the\n\nbirth certificate of the child or in connection with applying for or\n\nreceiving public assistance; and\n\n5. Any individual has formally or informally acknowledged or\n\nclaimed paternity of the child in a jurisdiction in which the woman\n\nresided during or since her pregnancy, or in which the child has\n\nresided or resides, at the time of the inquiry.\n\nC. If inquiry pursuant to subsection B of this section\n\nidentifies as the father or putative father of the child an\n\nindividual who has not received notice of the proceeding, the court\n\nshall require notice to be served upon him pursuant to Section 7505-\n\n2.1 or 7505-4.1 of this title.\n\nD. If, in an inquiry pursuant to this section, the woman who\n\ngave birth to the child fails to disclose the identity of a possible\n\nfather or reveal his whereabouts, she must be advised that the lack\n\nof information about the father's medical and genetic history may be\n\ndetrimental to the child. She should also be advised that any false\n\nstatement that she might make under oath or affirmation at a hearing\n\nor trial before the court regarding her knowledge of the identity or\n\nwhereabouts of a possible father, if she knows or believes that the\n\nstatement is not true or intends thereby to obstruct the\n\nascertainment of the truth, could constitute grounds for a criminal\n\nprosecution for perjury.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"84cc5f1b033d09dc7e27bdae7ab7169165bd955d0fb81fb94e892a7f674240d2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-7505-4.2","next":"us-ok/okla.-stat.-tit.-10-10-7505-5.1"},"notice":"GroundRules: Original legal text.
