It is the public policy of the State of Oklahoma that when\n\nan infant will be placed for adoption, a discharge of the infant\n\nfrom a medical facility shall be made as soon after birth as is\n\nmedically prudent to facilitate the placement that has been\n\narranged.\n\nB. It shall be unlawful for any physician, hospital, or any\n\nother person or entity to condition discharge of an infant from a\n\nmedical facility on the payment of any expense or to require a\n\ntemporary order from a court before discharging an infant. Upon\n\nreceipt of a written authorization of the birth mother, a medical\n\nfacility shall release an infant to the person or agency designated\n\nin the written authorization.\n\nC. Any physician, hospital, or any other person or entity that\n\nviolates the provisions of subsection B of this section shall be\n\nliable in a civil action for compensatory and punitive damages,\n\nshall be subject to injunctive remedies and a judgment for the\n\npayment of an aggrieved person's attorney fees and court costs.
