The Department of Human Services shall establish and\n\nadminister an ongoing program of adoption assistance for eligible\n\nspecial needs children in the legal custody of the Department or a\n\nfederally recognized Indian tribe, as defined by the federal Indian\n\nChild Welfare Act and the Oklahoma Indian Child Welfare Act, who are\n\nnot eligible for federally funded adoption assistance benefits.\n\nAdoption assistance benefits under this program shall be provided\n\nout of funds appropriated to the Department for the maintenance of\n\nchildren in foster care or made available to it from other sources.\n\nB. Adoption assistance benefits under this program may include\n\nMedicaid coverage, a monthly adoption assistance payment,\n\nreimbursement of nonrecurring adoption expenses, special services,\n\nor any combination of such benefits.\n\nC. To comply with 42 U.S.C., Section 471(a)(14) of the Social\n\nSecurity Act and 45 C.F.R., Section 1356.21(n), the Department shall\n\nlimit the number of children under the responsibility of the\n\nDepartment, who remain in substitute care for a period over twenty-\n\nfour (24) months, to no more than thirty percent (30%) of the\n\nchildren in care during any fiscal year.","path":["OK Code","Title 10"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3c44f7c522b25311341e75f30dbd83eb2fa2b3b98b8e68f25bd37d816cbc9abc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10-10-7510-1.2","next":"us-ok/okla.-stat.-tit.-10-10-7510-1.4"},"notice":"GroundRules: Original legal text.
