Stat. tit. 10, § 10-7510-1.5","heading":"Written agreement - Commencement of assistance -","body":"Amount - Preexisting condition - Periodic certification -\n\nTermination or modification - Continued eligibility regardless of\n\nresidence.\n\nA. 1. When a parent or parents are found and approved for\n\nadoption of a child who is determined by the Department of Human\n\nServices to be eligible for adoption assistance pursuant to the\n\nOklahoma Adoption Assistance Act, and before the final decree of\n\nadoption is entered, there must be a signed written agreement\n\nbetween the prospective adoptive parent or parents and the\n\nDepartment.\n\n2. Adoption assistance in individual cases may commence with\n\nthe adoptive placement or at the time of finalization of the\n\nadoption. Adoption assistance may be for special services only, or\n\nfor monthly money payments, and either for a limited period, or for\n\na long term, or for any combination of the foregoing.\n\nEligibility for and the rate of monthly adoption assistance\n\npayments shall be determined by the Department in accordance with\n\nrules promulgated by the Commission for Human Services.\n\nB. When an otherwise eligible child is determined to have a\n\ncausative, preexisting condition which was not identified or known\n\nprior to the legal finalization of the adoption and which has\n\nresulted in a severe medical or psychiatric condition that requires\n\nextensive treatment, hospitalization, or institutionalization, an\n\nadoption assistance agreement may be approved by the Department\n\nafter the final decree of adoption has been entered. In the event\n\nan adoption assistance agreement is approved that provides for\n\nmonthly adoption assistance payments, the adoptive parents may also\n\nbe entitled to receive retroactive adoption assistance payments for\n\na period not to exceed the two (2) months prior to the date the\n\nadoption assistance agreement was approved.\n\nC. Any child who met the requirements of the provisions of\n\nSections 7510-1.2 and 7510-1.4 of this title, and was determined\n\neligible for Oklahoma adoption assistance with respect to a prior\n\nadoption, and is available for adoption because the prior adoption\n\nhas been dissolved and the parental rights of the adoptive parents\n\nhave been terminated or because the adoptive parents of the child\n\nhave died, shall be eligible for Oklahoma adoption assistance with\n\nrespect to any subsequent adoption.\n\nD. 1. When adoption assistance benefits are for more than one\n\n(1) year, the Department shall send the adoptive parent or parents\n\nan Adoption Assistance Annual Review request and assure that the\n\nchild who has attained the minimum age for compulsory school\n\nattendance and is eligible for an adoption assistance payment under\n\nTitle IV-E of the Social Security Act, 42 U.S.C., Section 670 et\n\nseq. is:\n\na. enrolled in an institution that provides elementary or\n\nsecondary education as determined under the law of\n\nthis state or other jurisdiction in which the\n\ninstitution is located,\n\nb. instructed in elementary or secondary education by any\n\nother means legally authorized,\n\nc. in an independent study elementary or secondary\n\neducation program in accordance with the law of this\n\nstate or other jurisdiction in which the program is\n\nlocated, that is administered by the local school or\n\nschool district, or\n\nd. incapable of attending school on a full-time basis due\n\nto a documented medical condition supported by regular\n\nupdates.\n\n2. The adoptive parent or parents shall at all times keep the\n\nDepartment informed of circumstances including, but not limited to,\n\nwhether the adoptive parent or parents continue to be legally\n\nresponsible for support of the child which would make them\n\nineligible for such assistance payments or eligible for assistance\n\npayments in a different amount.\n\n3. The Department is authorized and directed to make a review\n\nof each adoption assistance agreement annually to assure that the\n\nparents are fulfilling their obligations under the agreement.\nesponsible for support of the child which would make them\n\nineligible for such assistance payments or eligible for assistance\n\npayments in a different amount.\n\n3. No payment may be made to any parents with respect to any\n\nchild who has attained the age of eighteen (18) years, except a\n\nchild may continue to receive assistance until the child reaches the\n\nage of nineteen (19) years if the child:\n\na. continues to attend high school or pursues General\n\nEducation Development, or\n\nb. meets the criteria for an adoption assistance\n\ndifficulty of care rate as determined by the\n\nDepartment.\n\n5. Termination or modification of the adoption assistance\n\nagreement may be requested by the adoptive parent or parents at any\n\ntime.\n\n6. No payment may be made to adoptive parents if the Department\n\ndetermines that the parents are no longer legally responsible for\n\nthe support of the child or that the child is no longer receiving\n\nany financial support from such parents.\n\nE. A child for whom an adoption assistance agreement has been\n\nreached with the Department shall remain eligible and receive\n\nadoption assistance benefits regardless of the domicile or residence\n\nof the adopting parent or parents at any given time.\n\nF.
