A man is presumed to be the father of a child if:\n\n1. He and the mother of the child are married to each other and\n\nthe child is born during the marriage;\n\n2. He and the mother of the child were married to each other\n\nand the child is born within three hundred (300) days after the\n\nmarriage is terminated by death, annulment, declaration of\n\ninvalidity, dissolution of marriage or after decree of separation;\n\n3. Before the birth of the child, he and the mother of the\n\nchild married each other in apparent compliance with law, even if\n\nthe attempted marriage is or could be declared invalid, and the\n\nchild is born during the invalid marriage or within three hundred\n\n(300) days after its termination by death, annulment, declaration of\n\ninvalidity, a decree of separation, or dissolution of marriage;\n\n4. After the birth of the child, he and the mother of the child\n\nmarried each other in apparent compliance with law, whether or not\n\nthe marriage is or could be declared invalid, and he voluntarily\n\nasserted his paternity of the child, and:\n\na. the assertion is in a record with the State Department\n\nof Health, Division of Vital Records or the Department\n\nof Human Services,\n\nb. he agreed to be and is named as the child’s father on\n\nthe child’s birth certificate, or\n\nc. he promised in a record to support the child as his\n\nown; or\n\n5. For the first two (2) years of the child’s life, he resided\n\nin the same household with the child and openly held out the child\n\nas his own.\n\nB.
