At any stage of a proceeding under the Oklahoma Children’s\n\nCode:\n\n1. The parent or legal guardian, the child’s attorney, or the\n\ndistrict attorney’s office may apply for use immunity for a parent\n\nor legal guardian for in-court testimony. The in-court testimony of\n\nan immunized parent or legal guardian shall not be used against that\n\nparent or legal guardian in a criminal prosecution; provided,\n\nhowever, that the parent or legal guardian may be prosecuted for\n\nperjury that occurs during the testimony of the parent or legal\n\nguardian in a deprived proceeding;\n\n2. The child’s attorney or the district attorney’s office may\n\napply for use immunity for any records, documents, or other physical\n\nobjects produced by the immunized parent or legal guardian in the\n\ndeprived proceeding, the production of which was compelled by a\n\ncourt order; or\n\n3. The child’s attorney or the district attorney’s office may\n\napply for use immunity for a parent or legal guardian for any\n\nstatement that a parent or legal guardian makes in the course of a\n\ncourt-ordered psychological evaluation or treatment program to the\n\nprofessional designated by the Department of Human Services or\n\nauthorized by the court in furtherance of the court’s order. Such\n\nimmunity shall attach only to those statements made during the\n\ncourse of the actual evaluation or treatment and specifically does\n\nnot attach to statements made to Department employees, agents, or\n\nother representatives in the course of the investigation of alleged\n\nchild abuse, neglect, or abandonment.\n\nB.
