The family drug court judge shall conduct a hearing to\n\ndetermine final eligibility of the family for the family drug court\n\nprogram by considering:\n\n1. Whether the child or children and family are appropriate for\n\nplacement in drug court, as provided in Section 8 of this act;\n\n2. The findings and recommendations of the family drug court\n\nassessment;\n\n3. Whether there is an appropriate treatment program available\n\nto the family and whether there is a recommended family drug court\n\ntreatment plan; and\n\n4. Any information relevant to determining eligibility. A\n\nfamily shall not be denied admittance to any family drug court\n\nprogram based upon the inability of the family to pay court costs or\n\nother costs or fees.\n\nB. The judge shall require the family to demonstrate support\n\nfor participation in the program. In order for the family to be\n\nadmitted to the program, every person responsible for the health or\n\nwelfare of the child or children and any adult who establishes a\n\npermanent residence in the home where the child or children reside\n\nafter the child or children have been admitted to the program shall\n\nsubmit to the personal jurisdiction of the court upon being properly\n\nserved pursuant to Section 1-4-304 of Title 10A of the Oklahoma\n\nStatutes or by personally appearing in court. Failure of an adult\n\nresponsible for the health or welfare of the child or children, or\n\nan adult who resides in the home with the child or children, to\n\nsubmit to the personal jurisdiction of the court shall result in\n\neither the family's dismissal from the drug court program, contempt\n\nof court proceedings for the adult, removal of the child or children\n\nfrom the home, or any combination thereof.\n\nC. When the court accepts the family drug court treatment plan,\n\nthe child or children and family shall be ordered immediately into\n\nthe program and the person responsible for the health or welfare of\n\nthe child or children and any adult who resides in the home of the\n\nchild or children shall have voluntarily signed the necessary court\n\ndocuments before the child or children and family may be admitted to\n\ntreatment. The court documents shall include:\n\n1. A written family drug court treatment plan, which is subject\n\nto modification at any time during the program, as set forth in\n\nSection 8 of this act;\n\n2. A statement requiring the child or children and family to\n\nenter the treatment program as directed by the court and to\n\nparticipate until completion, withdrawal, or removal by the court;\n\nand\n\n3. A statement signed voluntarily by the person or persons\n\nresponsible for the health or welfare of the child or children and\n\nany adult who resides in the home with the child or children that\n\nsuch person or persons shall comply with the orders of the court and\n\nany conditions of the treatment program and supervising staff for as\n\nlong as the family participates in the family drug court program.\n\nD. If admission into the family drug court program is denied,\n\nthe case shall be returned to the traditional juvenile docket and\n\nshall proceed as provided for any other juvenile case.\n\nE. At the time a child or children and family is admitted to\n\nthe family drug court program, any bond, bail or undertaking on\n\nbehalf of the child or children or family shall be exonerated.\n\nF. 1. A family shall actively participate in treatment for a\n\nperiod of not less than six (6) months while participating in the\n\nfamily drug court program.\n\n2.
