Stat. tit. 10A, § 10A-1-4-804","heading":"Notification of movement of child in the custody of","body":"Department of Human Services.\n\nA. 1. The Department of Human Services shall notify the court,\n\nthe postadjudication review board, the district attorney, the\n\nchild’s attorney, and the guardian ad litem of the child, if any,\n\nwhenever a child in the custody of the Department is moved from one\n\nlocation to another.\n\n2. The Department shall notify the foster family prior to\n\nmovement of the child pursuant to the provisions of Section 1-4-805\n\nof this title.\n\n3. The Department shall inform the guardian ad litem, if any,\n\nand the child’s attorney of the specific location of the child.\n\nB. The notification required by this section shall be made by\n\nthe Department within a reasonable time after the Department is made\n\naware of the need for movement, but in no event less than five (5)\n\njudicial days prior to movement unless an emergency exists. As used\n\nin this section, “emergency” means movement of a child that is:\n\n1. Pursuant to an order of the court including, but not limited\n\nto, an order authorizing placement of a child with a parent or\n\nsibling;\n\n2. Requested by the child-placing agency or foster parent of\n\nthe child, and the request is for immediate removal of the child\n\nwithout delay or notice as provided by this section;\n\n3. For emergency medical or mental health treatment;\n\n4. For substantial noncompliance by a foster parent or child-\n\nplacing agency with applicable placement standards and agreements\n\nsuch that the child is in imminent danger; or\n\n5. Due to a pending investigation of an allegation of abuse or\n\nneglect of a child by a foster parent or child-placing agency or\n\nother person residing in the foster family home.\n\nC. The court, on its own motion, may hold, or any party\n\nreceiving notice pursuant to this section, shall be granted, an\n\ninformal hearing concerning the reasons and necessity for moving the\n\nchild, if requested in writing, within five (5) days following the\n\nreceipt of notice.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cdf1cece4e490dd8c68aec7b1d5ba42a479b576dfa7f06522fe8dd069021da4e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-1-4-803","next":"us-ok/okla.-stat.-tit.-10a-10a-1-4-805"},"notice":"GroundRules: Original legal text.
