At any time prior to or following the adjudicatory hearing\n\nthe court, on its own motion or upon the motion of a party, may find\n\nthat reasonable efforts to prevent the removal of a child from home\n\nor to reunify the child and family are not required if the court\n\ndetermines, based upon a preponderance of the evidence, that:\n\n1. The parent or legal guardian of the child, who is an infant\n\nage twelve (12) months or younger, has abandoned the child;\n\n2. The parent or legal guardian of the child has:\n\na. committed murder or manslaughter of any child,\n\nb. aided or abetted, attempted, conspired, or solicited\n\nto commit the murder or manslaughter of any child,\n\nc. committed a felony assault upon any child that\n\nresulted in the child receiving serious bodily injury,\n\nor\n\nd. subjected any child to aggravated circumstances\n\nincluding, but not limited to, heinous and shocking\n\nabuse or heinous and shocking neglect;\n\n3. The parental rights of a parent to the child's sibling have\n\nbeen terminated involuntarily;\n\n4. The parent has been found by a court of competent\n\njurisdiction to have committed sexual abuse against the child or\n\nanother child of the parent; or\n\n5. The parent is required to register with a sex offender\n\nregistry pursuant to Section 113(a) of the Adam Walsh Child\n\nProtection and Safety Act of 2006, 42 U.S.C., Section 16913(a).\n\nB. The court shall conduct a permanency hearing within thirty\n\n(30) days of a determination by the court that any of the conditions\n\nspecified in subsection A of this section exist.
