Juvenile court records and Department of Human Services\n\nagency records pertaining to a child may be inspected, and their\n\ncontents shall be disclosed, without a court order to the following\n\npersons upon showing of proper credentials and pursuant to their\n\nlawful duties:\n\n1. The court having the child currently before it in any\n\nproceeding pursuant to this title, any district court or tribal\n\ncourt to which such proceedings may be transferred, employees and\n\nofficers of the court in the performance of their duties, including\n\nbut not limited to guardians ad litem appointed by the court, and\n\ncourt-appointed special advocates;\n\n2. A district attorney, United States Attorney, or Attorney\n\nGeneral of this or another state and the employees of such offices\n\nin the course of their official duties pursuant to this title or the\n\nprosecution of crimes against children, or upon their request in\n\ntheir official capacity as advisor in a grand jury proceeding;\n\n3. The attorney representing a child who is the subject of a\n\nproceeding pursuant to the provisions of this title or other\n\nproceeding where child custody or visitation is at issue;\n\n4. Employees of juvenile bureaus in the course of their\n\nofficial duties pursuant to this title, and employees of the\n\nDepartment of Human Services in the course of their official duties;\n\n5. Employees of a law enforcement agency of this or another\n\nstate or military enclave and employees of a child protective\n\nservice of another state or military enclave in the course of their\n\nofficial duties pertaining to investigations of a report of known or\n\nsuspected child abuse or neglect or crimes against children or for\n\nthe purpose of determining whether to place a child in protective\n\ncustody;\n\n6. The Oklahoma Commission on Children and Youth as provided by\n\nSections 601.2 and 601.6 of Title 10 of the Oklahoma Statutes;\n\n7. The Office of Juvenile Affairs;\n\n8. A federally recognized Indian tribe in which the child who\n\nis the subject of the record is a member or is eligible to become a\n\nmember of the tribe and is the biological child of a member of an\n\nIndian tribe pursuant to the provisions of the Federal Indian Child\n\nWelfare Act and the Oklahoma Indian Child Welfare Act; provided such\n\nIndian tribe, in the course of its official duties, is:\n\na. investigating a report of known or suspected child\n\nabuse or neglect or crimes against children or for the\n\npurpose of determining whether to place a child in\n\nprotective custody,\n\nb. providing services to or for the benefit of a child\n\nincluding, but not limited to, protective, emergency,\n\nsocial and medical services, or\n\nc. the tribe, the tribal court or the tribal child\n\nwelfare program has asserted jurisdiction or\n\nintervened in any case in which the child is the\n\nsubject of the proceedings or is a party to the\n\nproceedings pursuant to the authority provided in the\n\nOklahoma Indian Child Welfare Act.\n\nThe records that are to be provided to Indian tribes under this\n\nsubsection shall include all case records, reports, and documents as\n\ndefined in Section 1-6-101 of this title;\n\n9. The Governor or to any person the Governor designates, in\n\nwriting;\n\n10. Any federal official of the United States Department of\n\nHealth and Human Services;\n\n11. Any member of the Legislature approved in writing by the\n\nSpeaker of the House of Representatives or the President Pro Tempore\n\nof the Senate;\n\n12. A foster parent, with regard to records concerning the\n\nsocial, medical, psychological, or educational needs of a child\n\ncurrently placed with that foster parent or of a child being\n\nconsidered for placement with that foster parent;\n\n13. An employee of any state or federal corrections or law\n\nenforcement agency in the performance of the official duties of the\n\nemployee concerning presentence investigations or supervision of a\n\nparent of an alleged or adjudicated deprived child, or the legal\national needs of a child\n\ncurrently placed with that foster parent or of a child being\n\nconsidered for placement with that foster parent;\n\n13. An employee of any state or federal corrections or law\n\nenforcement agency in the performance of the official duties of the\n\nemployee concerning presentence investigations or supervision of a\n\nparent of an alleged or adjudicated deprived child, or the legal\n\nguardian, custodian, or any other adult member of the child’s home\n\nwho is responsible for the health, safety, or welfare of the child;\n\n14. An employee of a state agency of this or another state in\n\nthe performance of the official duties of the employee concerning\n\nthe establishment of paternity or the establishment or enforcement\n\nof a child support order or other entitlement for the benefit of a\n\nchild; provided, disclosure shall be limited to information directly\n\nrelated to the purpose of such disclosure;\n\n15. Any member of a city-county Health Department Fetal Infant\n\nMortality Review (FIMR) in the performance of the official duties of\n\nthe member concerning investigations of fetal and infant\n\nmortalities; provided, disclosure shall be limited to information\n\ndirectly related to the purpose of such disclosure;\n\n16. Any designated federal authorities at the federal military\n\ninstallation where a service member is assigned, when the child is a\n\nmember of an active duty military family, as provided by paragraph 4\n\nof subsection A of Section 1-2-102 of this title;\n\n17. Any member of the Child Welfare Review Committee for the\n\nDeath and Near Death of Children With Disabilities as established by\n\nSection 1-10-103 of this title; and\n\n18. The Office of Client Advocacy within the State Department\n\nof Health.\n\nB. In addition to the persons listed in subsection A of this\n\nsection, juvenile court records may be inspected, and their contents\n\nshall be disclosed, without a court order to the following persons\n\nupon showing of proper credentials and pursuant to their lawful\n\nduties:\n\n1. Employees of court-appointed special advocate programs, as\n\ndefined in Section 1-1-105 of this title, in the course of their\n\nofficial duties pertaining to recruiting, screening, training,\n\nassigning cases, supervising, and supporting volunteers in their\n\nroles as guardian ad litem pursuant to Section 1-4-306 of this\n\ntitle;\n\n2. Members of postadjudication review boards established\n\npursuant to the provisions of Section 1116.2 of Title 10 of the\n\nOklahoma Statutes, the Child Death Review Board, and\n\nmultidisciplinary personnel. In addition to juvenile court records,\n\nmembers of such postadjudication review boards may inspect, without\n\na court order, information that includes, but is not limited to:\n\na. psychological and medical records,\n\nb. placement history and information, including the names\n\nand addresses of foster parents,\n\nc. family assessments,\n\nd. treatment or service plans, and\n\ne. school records;\n\n3. The Department of Human Services or other public or private\n\nagency or individual having court-ordered custody or physical\n\ncustody pursuant to Department placement of the child, or conducting\n\na child abuse or neglect investigation of the child who is the\n\nsubject of the record. In addition to juvenile court records,\n\nemployees of the Department may inspect, without a court order and\n\nupon a showing of proper credentials and pursuant to their lawful\n\nduties, information that includes, but is not limited to:\n\na. psychological and medical records, and\n\nb. nondirectory education records;\n\n4. The child who is the subject of the record and the parents,\n\nlegal guardian, custodian, or foster parent of such child; and\n\n5. A person authorized by the court to conduct bona fide\n\nresearch, provided such research may not publish the names or\n\nidentities of parents, children, or other persons contained in the\n\nrecords.\n\nC. In addition to the persons and entities named in subsection\nrecords;\n\n4. The child who is the subject of the record and the parents,\n\nlegal guardian, custodian, or foster parent of such child; and\n\n5. A person authorized by the court to conduct bona fide\n\nresearch, provided such research may not publish the names or\n\nidentities of parents, children, or other persons contained in the\n\nrecords.\n\nC. In addition to the persons and entities named in subsection\n\nA of this section, Department of Human Services agency records may\n\nbe inspected, and their contents shall be disclosed, without a court\n\norder to the following persons upon showing of proper credentials\n\nand pursuant to their lawful duties:\n\n1. Postadjudicatory review boards, court-appointed special\n\nadvocates, and members of the Child Death Review Board;\n\n2. Any district court which has ordered a home study by the\n\nDepartment in an action for divorce, annulment, custody of a child,\n\nor appointment of a legal guardian of a child, or any subsequent\n\nproceeding in such actions; provided, however, the Department may\n\nlimit disclosure in the home study to summaries or to information\n\ndirectly related to the purpose of the disclosure;\n\n3. Members of multidisciplinary teams or multidisciplinary\n\npersonnel designated by the Department, investigating a report of\n\nknown or suspected child abuse or neglect or providing services to a\n\nchild or family which is the subject of the report;\n\n4. A physician who has before him or her a child whom the\n\nphysician reasonably suspects may be abused or neglected or any\n\nhealth care or mental health professionals involved in the\n\nevaluation or treatment of the child or the parents, legal guardian,\n\nfoster parent, custodian, or other family members of the child;\n\n5. Any public or private agency or person authorized by the\n\nDepartment to diagnose, or provide care, treatment, supervision, or\n\nother services to a child who is the subject of a report or record\n\nof child abuse or neglect; provided, the Department may limit such\n\ndisclosure to summaries or to information directly necessary for the\n\npurpose of such disclosure;\n\n6. Any person or agency for research purposes, if all of the\n\nfollowing conditions are met:\n\na. the person or agency conducting the research is\n\nemployed by the State of Oklahoma or is under contract\n\nwith this state and is authorized by the Department to\n\nconduct the research, and\n\nb. the person or agency conducting the research ensures\n\nthat all documents containing identifying information\n\nare maintained in secure locations and access to the\n\ndocuments by unauthorized persons is prohibited; that\n\nno identifying information is included in documents\n\ngenerated from the research conducted; and that all\n\nidentifying information is deleted from documents used\n\nin the research when the research is completed;\n\n7. The Oklahoma Health Care Authority; and\n\n8. A medical examiner when such person is determining the cause\n\nof death of a child.\n\nD. In accordance with the rules promulgated for such purpose\n\npursuant to Section 620.6 of Title 10 of the Oklahoma Statutes,\n\nrecords listed in subsection A of Section 1-6-102 of this title may\n\nbe inspected and their contents disclosed without a court order to\n\nparticipating agencies.\n\nE. The court may disclose to an employee of an out-of-state\n\nentity, licensed to perform adoption home studies in that state,\n\nwhether the prospective adoptive parent has had parental rights to a\n\nchild terminated in Oklahoma or whether the prospective adoptive\n\nparent has relinquished parental rights to a child in Oklahoma.\n\nF.
