Except as otherwise provided by law, the Department of\n\nHuman Services or the Office of Juvenile Affairs shall not place a\n\nchild in a foster home prior to completion of:\n\na. a foster parent eligibility assessment on the foster\n\nparent applicant,\n\nb. a national criminal history records search based upon\n\nsubmission of fingerprints for any adult residing in\n\nthe home, as required by the Oklahoma Child Care\n\nFacilities Licensing Act and the Oklahoma Children's\n\nCode,\n\nc. a Motor Vehicle Report obtained from the Department of\n\nPublic Safety regarding each adult residing in the\n\nhome, and\n\nd. a check of any child abuse registry maintained by a\n\nstate in which the prospective foster parent or any\n\nadult living in the home of the prospective foster\n\nparent has resided in the preceding five (5) years.\n\nProvided, however, the state agencies may place a child in the home\n\nof a foster parent, pending completion of the national criminal\n\nhistory records search, if the foster parent and every adult\n\nresiding in the home of the foster parent have resided in this state\n\nfor at least five (5) years immediately preceding placement. The\n\ndirector of such state agency or designee may authorize an exception\n\nto the fingerprinting requirement for any person residing in the\n\nhome who has a severe physical condition which precludes such person\n\nfrom being fingerprinted.\n\n2. a. The Department shall be the lead agency for\n\ndisseminating fingerprint cards to courts and child-\n\nplacing agencies for obtaining and requesting a\n\nnational criminal history records search based upon\n\nsubmission of fingerprints from the Oklahoma State\n\nBureau of Investigation. The Office of Juvenile\n\nAffairs may directly request national criminal history\n\nrecords searches as defined by Section 150.9 of Title\n\n74 of the Oklahoma Statutes from the Oklahoma State\n\nBureau of Investigation for the purpose of obtaining\n\nthe national criminal history of any individual for\n\nwhich such a search is required pursuant to this\n\nsection.\n\nb. Courts and child-placing agencies may request the\n\nDepartment to obtain from the Oklahoma State Bureau of\n\nInvestigation a national criminal history records\n\nsearch based upon submission of fingerprints for\n\nfoster parents and other persons requiring such search\n\npursuant to the Oklahoma Child Care Facilities\n\nLicensing Act and the Oklahoma Children's Code. Any\n\nfees charged by the Oklahoma State Bureau of\n\nInvestigation or the Federal Bureau of Investigation\n\nfor such searches shall be paid by the requesting\n\nentity.\n\nc. Either the Department or the Office of Juvenile\n\nAffairs, whichever is applicable, shall contract with\n\nthe Oklahoma State Bureau of Investigation to obtain\n\nnational criminal history records searches based upon\n\nsubmission of fingerprints.\n\nB. A child-placing agency shall not place a child who is in the\n\ncustody of the agency in a foster home until completion of a foster\n\nparent eligibility assessment and a national criminal history\n\nrecords search based upon submission of fingerprints has been\n\ncompleted for each individual residing in the home in which the\n\nchild will be placed, as required pursuant to the Oklahoma Child\n\nCare Facilities Licensing Act or the Oklahoma Children's Code, and a\n\ncheck of any child abuse registry maintained by a state in which the\n\nprospective foster parent or any adult living in the home of the\n\nprospective foster parent has resided in the past five (5) years;\n\nprovided, however, the child-placing agency may place a child in a\n\nfoster family home pending completion of the national criminal\n\nhistory records search if the foster parent and every adult residing\n\nin the home have resided in this state for at least five (5) years\n\nimmediately preceding the placement.\n\nC. 1. Whenever a court awards custody of a child to an\nresided in the past five (5) years;\n\nprovided, however, the child-placing agency may place a child in a\n\nfoster family home pending completion of the national criminal\n\nhistory records search if the foster parent and every adult residing\n\nin the home have resided in this state for at least five (5) years\n\nimmediately preceding the placement.\n\nC. 1. Whenever a court awards custody of a child to an\n\nindividual or a child-placing agency other than the Department or\n\nthe Office of Juvenile Affairs, for placement of the child, the\n\ncourt shall:\n\na. require that when custody is placed with an\n\nindividual, a foster family eligibility assessment be\n\nconducted for the foster parents prior to placement of\n\nthe child, and\n\nb. require that if custody is awarded to a child-placing\n\nagency, a foster family eligibility assessment be\n\nconducted as required by the Oklahoma Child Care\n\nFacilities Licensing Act.\n\n2. A child-placing agency other than the Department or the\n\nOffice of Juvenile Affairs shall, within thirty (30) days of\n\nplacement, provide for an assessment of the child for the purpose of\n\nestablishing an appropriate individualized service plan for the\n\nchild. The court shall require the individualized service plan to\n\nbe completed in substantially the same form and with the same\n\ncontent as required by the Oklahoma Children's Code for a deprived\n\nchild or as required by the Oklahoma Juvenile Code for a delinquent\n\nchild or a child in need of supervision.\n\n3. The child shall receive a complete medical examination\n\nwithin thirty (30) days of initial placement unless a medical\n\nexamination was conducted on the child upon the removal of the child\n\nand the court finds no need for an additional examination.\n\n4. The child may receive such further diagnosis and evaluation\n\nas necessary as determined by the court to preserve the physical and\n\nmental well-being of the child.\n\nD. When the court awards custody of a child to an individual or\n\na child-placing agency as provided by this section, the individual\n\nor child-placing agency shall be responsible for the completion of\n\nand costs of the national criminal history records search based upon\n\nsubmission of fingerprints, the foster parent eligibility\n\nassessment, the preparation of an individualized service plan, and\n\nthe medical examination required by this section.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6c5de9a2e9a7ec440b27be0bc7e08c2258d66e105f42ecd1f64d0c2ea9610ae1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-1-7-110","next":"us-ok/okla.-stat.-tit.-10a-10a-1-7-112"},"notice":"GroundRules: Original legal text.
