Stat. tit. 10A, § 10A-1-8-102","heading":"Court-appointed special advocate – Education and","body":"training – Criminal history search – Civil liability immunity.\n\nA. Any court-appointed special advocate (CASA) available for\n\nappointment pursuant to the Oklahoma Children's Code or the Oklahoma\n\nJuvenile Code shall complete education and training courses in\n\naccordance with national and Oklahoma CASA standards.\n\nB. No court-appointed special advocate shall be assigned a case\n\nbefore:\n\n1. Completing a training program in compliance with nationally\n\ndocumented Court-Appointed Special Advocate standards.\n\nDocumentation of training shall be submitted annually by local\n\ncourt-appointed special advocate programs to the Oklahoma Court-\n\nAppointed Special Advocate Association; and\n\n2. Being approved by the local court-appointed special advocate\n\nprogram, which will include appropriate criminal background checks\n\nas provided in subsection C of this section.\n\nC. 1. Notwithstanding any other provision of law, each local\n\ncourt-appointed special advocate program shall require for any\n\nperson making application to become a court-appointed special\n\nadvocate volunteer or to be employed by the local court-appointed\n\nspecial advocate program:\n\na. a child welfare records search conducted by the\n\nDepartment of Human Services, which shall consist of a\n\nsearch of the Child Abuse and Neglect Information\n\nSystem maintained by the Department of Human Services\n\nfor review by authorized entities,\n\nb. a criminal history records search conducted by the\n\nOklahoma State Bureau of Investigation, and\n\nc. any other background check meeting the requirements as\n\nset forth in Oklahoma Court-Appointed Special Advocate\n\nAssociation state or national standards for local\n\nprograms.\n\n2. If the prospective court-appointed special advocate\n\nvolunteer or employee of the local court-appointed special advocate\n\nprogram has lived in Oklahoma for less than one (1) year, a criminal\n\nhistory records search shall also be obtained from the criminal\n\nhistory state repository of the previous state of residence.\n\nD. 1. Any person participating in a judicial proceeding as a\n\ncourt-appointed special advocate shall be presumed prima facie to be\n\nacting in good faith and in so doing shall be immune from any civil\n\nliability that otherwise might be incurred or imposed.\n\n2. Any person serving in a management position of a court-\n\nappointed special advocate organization, including a member of the\n\nBoard of Directors acting in good faith, shall be immune from any\n\ncivil liability or any vicarious liability for the negligence of any\n\ncourt-appointed special advocate organization advocates, managers,\n\nor directors.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a57fd09b1bd20b2979fbc4f1293e440b85e668010a862b39fd8e9f55d84fcca2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-1-8-101","next":"us-ok/okla.-stat.-tit.-10a-10a-1-8-103"},"notice":"GroundRules: Original legal text.
