To the extent allowed by federal law, no private child-\n\nplacing agency shall be required to perform, assist, counsel,\n\nrecommend, consent to, refer, or participate in any placement of a\n\nchild for foster care or adoption when the proposed placement would\n\nviolate the agency's written religious or moral convictions or\n\npolicies.\n\nB. The Department of Human Services shall not deny an\n\napplication for an initial license or renewal of a license or revoke\n\nthe license of a private child-placing agency because of the\n\nagency's objection to performing, assisting, counseling,\n\nrecommending, consenting to, referring, or participating in a\n\nplacement that violates the agency's written religious or moral\n\nconvictions or policies.\n\nC. A state or local government entity may not deny a private\n\nchild-placing agency any grant, contract, or participation in a\n\ngovernment program because of the agency's objection to performing,\n\nassisting, counseling, recommending, consenting to, referring, or\n\nparticipating in a placement that violates the agency's written\n\nreligious or moral convictions or policies.\n\nD. Refusal of a private child-placing agency to perform,\n\nassist, counsel, recommend, consent to, refer, or participate in a\n\nplacement that violates the agency's written religious or moral\n\nconvictions or policies shall not form the basis of a civil action.\n\nE. Notwithstanding the provisions of this section, a private\n\nchild-placing agency shall not refuse to perform any act otherwise\n\nrequired by state or federal law, or authorize any act otherwise\n\nprohibited by state or federal law.
