The Department of Human Services shall not:\n\n1. Require any current or prospective adoptive or foster parent\n\nto affirm, accept, or support any government policy regarding sexual\n\norientation or gender identity that conflicts with the parent’s\n\nsincerely held religious or moral beliefs as a condition for\n\neligibility to adopt or foster;\n\n2. Deny a current or prospective adoptive or foster parent any\n\nauthorization necessary to be eligible to adopt or foster based, in\n\nwhole or in part, upon the parent’s sincerely held religious or\n\nmoral beliefs, or intent to guide, instruct, or raise a child\n\nconsistent with those beliefs, regarding sexual orientation or\n\ngender identity; or\n\n3. Establish or enforce any standard, rule, or policy that\n\nprecludes consideration of a current or prospective adoptive or\n\nfoster parent for any particular placement based, in whole or in\n\npart, upon the parent’s sincerely held religious or moral beliefs\n\nregarding sexual orientation or gender identity.\n\nB. Nothing in this section shall:\n\n1. Preclude the Department from taking into account the\n\nreligious or moral beliefs of a particular adoptive or foster child,\n\nor his or her family of origin including, but not limited to, the\n\nchild’s or family’s views regarding sexual orientation and gender\n\nidentity, considered in relation to the religious or moral beliefs\n\nof a prospective adoptive or foster parent when determining which\n\nplacement is in the best interest of the child; or\n\n2.
