This section shall be known and may be cited as the\n\n\"Successful Adulthood Act\".\n\nB. The purpose of the Successful Adulthood Act shall be:\n\n1. To ensure that eligible individuals, who have been or are in\n\nthe foster care program of the Department of Human Services or a\n\nfederally recognized Indian tribe with whom the Department has a\n\ncontract, due to abuse or neglect, receive the protection and\n\nsupport necessary to allow those individuals to become self-reliant\n\nand productive citizens through the provision of requisite services\n\nthat include, but are not limited to, transitional planning,\n\nhousing, medical coverage, and education; provided, that eligibility\n\nfor tuition waivers shall be as set forth in Section 3230 of Title\n\n70 of the Oklahoma Statutes;\n\n2. To break the cycle of abuse and neglect that obligates the\n\nstate to assume custody of children; and\n\n3. To help children who have experienced foster care at age\n\nfourteen (14) or older achieve meaningful permanent connections with\n\na caring adult.\n\nC. An individual is eligible to receive services for the\n\ntransition of the child to a successful adulthood from the age of\n\nfourteen (14) until the age of eighteen (18), during the time the\n\nindividual is in the custody of the Department or a federally\n\nrecognized Indian tribe and in an out-of-home placement.\n\nD. The permanency plan for the child in transition to a\n\nsuccessful adulthood shall be developed in consultation with the\n\nchild and, at the option of the child, with up to two members of the\n\npermanency planning team to be chosen by the child, excluding the\n\nfoster parent and caseworker for the child, subject to the following\n\nprovisions:\n\n1. One individual selected by the child may be designated to be\n\nthe advisor and, as necessary, advocate of the child, with respect\n\nto the application of the reasonable and prudent parent standard to\n\nthe child; and\n\n2. The Department may reject an individual selected by the\n\nchild to be a member of the permanency planning team at any time if\n\nthe Department has good cause to believe that the selected\n\nindividual would not act in the best interests of the child.\n\nE. 1. Each child in foster care under the responsibility of\n\nthe Department or a federally recognized Indian tribe and in an out-\n\nof-home placement, who has attained fourteen (14) years of age shall\n\nbe given a written Notice of Rights that describes the following\n\nspecific rights of the child:\n\na. the rights of the child with respect to education,\n\nhealth, visitation, and court participation,\n\nb. the right to be provided with the documents specified\n\nin subsection F of this section, and\n\nc. the right to stay safe and avoid exploitation.\n\n2. The child shall sign an acknowledgment stating that the\n\nchild has been provided with a copy of the Notice of Rights and that\n\nthe rights described in the notice have been explained to the child\n\nin an age-appropriate way.\n\nF. A child about to leave foster care by reason of having\n\nattained eighteen (18) years of age and who has been in foster care\n\nfor at least six (6) months shall be given the following documents\n\npertaining to the child:\n\n1. An official or certified copy of the United States birth\n\ncertificate;\n\n2. A Social Security card issued by the Commissioner of Social\n\nSecurity;\n\n3. Health insurance information;\n\n4. A copy of the medical records of the child;\n\n5. A state-issued driver license or identification card; and\n\n6. Official documentation necessary to show that the child was\n\npreviously in foster care.\n\nG. Successful adulthood services may continue to the age of\n\ntwenty-one (21), provided the individual is in the custody of the\n\nDepartment or a federally recognized Indian tribe due to abuse or\n\nneglect and is in an out-of-home placement at the time of the\n\nindividual's sixteenth birthday.\n\nH. Individuals who are sixteen (16) years of age or older, who\nat the child was\n\npreviously in foster care.\n\nG. Successful adulthood services may continue to the age of\n\ntwenty-one (21), provided the individual is in the custody of the\n\nDepartment or a federally recognized Indian tribe due to abuse or\n\nneglect and is in an out-of-home placement at the time of the\n\nindividual's sixteenth birthday.\n\nH. Individuals who are sixteen (16) years of age or older, who\n\nhave been released from the custody of the Department or federally\n\nrecognized Indian tribe due to the entry of an adoption decree or\n\nguardianship order are eligible to receive successful adulthood\n\nservices until the age of twenty-one (21).\n\nI. Individuals who are eligible for services pursuant to the\n\nSuccessful Adulthood Act and who are between eighteen (18) and\n\ntwenty-one (21) years of age shall be eligible for Medicaid\n\ncoverage, provided such individuals were also in the custody of the\n\nDepartment or a federally recognized Indian tribe on the date they\n\nreached eighteen (18) years of age and meet Medicaid financial\n\neligibility guidelines.\n\nJ. The Department, in conjunction with the Oklahoma State\n\nRegents for Higher Education, shall provide parents and legal\n\nguardians of foster youth with information on the Oklahoma Higher\n\nLearning Access Program (OHLAP) including, but not limited to,\n\neligibility, application guidelines, academic requirements, and any\n\nother information required by the Oklahoma Higher Learning Access\n\nAct for participation in the Program.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a375bed5468a5f90b0e0948975835e121585536e248281ace876ad775afffc6a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-1-9-106","next":"us-ok/okla.-stat.-tit.-10a-10a-1-9-108"},"notice":"GroundRules: Original legal text.
