Stat. tit. 10A, § 10A-1-9-110","heading":"Community-based services and care for deprived","body":"children - Grants and contracts.\n\nA. 1. The Department of Human Services shall, to the extent of\n\nfunds available, directly or by grant or contract, develop and\n\nimplement a diversity of community-based services and\n\ncommunity-based care for children who are alleged or adjudicated\n\ndeprived. Community-based services are prevention and remedial\n\nservices including, but not limited to:\n\na. home-based counseling, therapy, and crisis\n\nintervention services,\n\nb. nonresidential educational, vocational, social and\n\npsychological diagnostic and counseling services,\n\nc. substance abuse treatment, sexual abuse treatment,\n\nemergency shelter and foster care, and other related\n\nprotection, prevention and treatment services which\n\nare provided, whenever practicable, in or near a\n\nchild's home community.\n\n2. If a child is placed with a noncustodial parent, the\n\nnoncustodial parent's home shall be construed to be the child's home\n\ncommunity. Community-based care is care in a foster home, group\n\nhome, community residential center or similar nonsecure facility\n\nconsistent with the individualized treatment needs of the child and\n\nprovided, whenever practicable, in or near a child's home community.\n\n3. The Department is authorized to contract with any federal,\n\nstate, local, or tribal governmental agency, or with any qualified\n\nprivate person, association, or agency to develop, administer,\n\ncoordinate, or provide community-based services and community-based\n\ncare.\n\nB. The Department shall establish procedures for the letting of\n\ngrants or contracts, and the conditions and requirements for the\n\nreceipt of such grants or contracts, for community-based services\n\nand community-based care. A copy of the procedures shall be made\n\navailable to any member of the general public upon request.\n\nC. Requests for proposals developed by the Department shall be\n\nbased upon documented client and service needs and identified\n\npriorities. The request for proposals shall clearly identify the\n\nprogram or services requirements, the population to be served, and\n\nperformance expectations. The agency shall adopt clear, written\n\nguidelines to ensure uniformity in the management, monitoring, and\n\nenforcement of contracts for services. If in-state private\n\nproviders are unable or unwilling to respond to the proposal, then\n\nout-of-state providers should be encouraged to respond.\n\nD. Nothing in this section shall serve to limit the authority\n\nof the Department to secure federal funding for community-based\n\nservices and community-based care or compliance by the Department\n\nwith federal law and regulations governing the expenditure of such\n\nfunds.\n\nE. Any state-funded grant or contract for the establishment of\n\ncommunity residential care or treatment facilities for children\n\nshall require, as a condition for receipt of such grant or contract,\n\ndocumented assurance from the agency or organization establishing\n\nsuch facility that appropriate arrangements have been made for\n\nproviding the educational services to which residents of the\n\nfacility are entitled pursuant to state and federal law.\n\nF. The Department is authorized to, and shall, enter into\n\ncooperative agreements with the Department of Juvenile Justice for\n\nthe use by both Departments of existing community-based programs,\n\nmanagement information, and client tracking systems, and other\n\nshared resources as deemed necessary or appropriate by both\n\nDepartments.\n\nG. 1. The Department is authorized to expend a sum not to\n\nexceed One Million Four Hundred Thousand Dollars ($1,400,000.00)\n\nfrom monies appropriated for that purpose from the Human Services\n\nFund during each fiscal year for the purpose of:\n\na. providing subsidy payments to licensed nonprofit child\n\ncare institutions within the State of Oklahoma to\n\nfurnish food, clothing, shelter, and upkeep for\n\nOklahoma children, and\n\nb. assisting the agency in developing a more\nMillion Four Hundred Thousand Dollars ($1,400,000.00)\n\nfrom monies appropriated for that purpose from the Human Services\n\nFund during each fiscal year for the purpose of:\n\na. providing subsidy payments to licensed nonprofit child\n\ncare institutions within the State of Oklahoma to\n\nfurnish food, clothing, shelter, and upkeep for\n\nOklahoma children, and\n\nb. assisting the agency in developing a more\n\ncomprehensive program to meet the needs of each child\n\nin the program including, but not limited to, social\n\nservices, recreational activities and individual and\n\nfamily counseling with the goal of returning the child\n\nto his or her family.\n\n2. Such subsidy shall be made on a per capital basis not to\n\nexceed One Thousand Two Hundred Dollars ($1,200.00) per year and\n\nshall be expended in twelve (12) monthly payments beginning July 1\n\nof the fiscal year.
