Upon the effective date of this act, the Office of Client\n\nAdvocacy within the Department of Human Services shall transfer to\n\nthe State Department of Health. The Office of Client Advocacy and\n\nthe Advocate General shall continue to exercise their statutory\n\npowers and duties.\n\nB. All equipment, supplies, records, matters pending, assets,\n\nfuture liabilities, fund balances, encumbrances, obligations,\n\nindebtedness, and legal and contractual rights and responsibilities\n\nof the Office of Client Advocacy shall be transferred to the State\n\nDepartment of Health.\n\nC. Any monies accruing to or in the name of the Office of\n\nClient Advocacy on and after the effective date of this act, or any\n\nmonies that accrue in any funds or accounts or are maintained for\n\nthe benefit of the Office of Client Advocacy on and after the\n\neffective date of this act, shall be transferred to the State\n\nDepartment of Health.\n\nD. The Department of Human Services and the State Department of\n\nHealth may enter into an agreement for the transfer of personnel.\n\nNo employee shall be transferred to the State Department of Health\n\nexcept on the freely given written consent of the employee. Any\n\nemployee who is transferred shall not be required to accept a lesser\n\ngrade or salary than presently received. All employees shall retain\n\nleave, sick, and annual time earned, and any retirement and\n\nlongevity benefits which have accrued during their tenure with the\n\nDepartment of Human Services. The transfer of personnel between the\n\nstate agencies shall be coordinated with the Office of Management\n\nand Enterprise Services.\n\nE. The Director of the Office of Management and Enterprise\n\nServices shall coordinate the transfer of funds, allotments,\n\npurchase orders, and outstanding financial obligations or\n\nencumbrances as provided for in this section.\n\nF. Upon the effective date of this act, all administrative\n\nrules promulgated by the Director of Human Services for the Office\n\nof Client Advocacy shall be transferred to and become a part of the\n\nadministrative rules of the State Department of Health. The Office\n\nof Administrative Rules in the Office of the Secretary of State\n\nshall provide adequate notice in “The Oklahoma Register” of the\n\ntransfer of such rules and shall place the transferred rules under\n\nthe Oklahoma Administrative Code title of the State Department of\n\nHealth.
