The Department of Human Services and each child-placing\n\nagency shall develop:\n\n1. A foster care education program to provide training for\n\npersons intending to furnish foster care services; and\n\n2. Continuing educational programs for foster parents.\n\nB. 1. In addition to any other conditions and requirements\n\nspecified by the state agency or child-placing agency, as\n\napplicable, prior to placement of a child in foster placement other\n\nthan kinship care, each foster parent shall have completed the\n\ntraining approved by the Department or the child-placing agency, as\n\nappropriate.\n\n2. A foster parent providing kinship foster care shall, if\n\npossible, complete the training developed by the Department for\n\nkinship foster care prior to placement or at such other times as\n\nrequired by the Department; provided, however, in no event shall\n\ntraining take place later than one hundred twenty (120) days after\n\nplacement of the child with the kinship foster parent. Until a\n\nkinship foster parent receives final approval from the Department to\n\nprovide foster care services to a child, the kinship foster parent\n\nshall not be eligible to receive any payment for providing foster\n\ncare services.\n\n3. Approved training shall require a minimum of twelve (12)\n\nhours of study related, but not limited, to physical care,\n\neducation, learning disabilities, procedures for referral to and\n\nreceipt of necessary professional services, behavioral assessment\n\nand modification, transition to successful adulthood skills, and\n\nprocedures for biological parent contact. Such training shall\n\nrelate to the area of parental substitute authority, the reasonable\n\nand prudent parent standard relative to child participation in age-\n\nappropriate or developmentally appropriate activities, behavioral\n\nmanagement techniques including, but not limited to, parent-child\n\nconflict resolution techniques, stress management, and any other\n\nappropriate technique to teach the foster parent how to manage the\n\nchild's behavior in a manner appropriate to the age and development\n\nof the foster child.\n\n4. The foster parent or person intending to provide foster care\n\nservices may complete the training as part of an approved training\n\nprogram offered by a public or private agency with expertise in the\n\nprovision of child foster care or in related subject areas.\n\nC. In order to assist persons providing kinship foster care,\n\nthe Department shall immediately refer kinship foster parents and\n\nthe child for assistance under the Temporary Assistance for Needy\n\nFamilies Program until the certification and training requirements\n\nhave been completed.\n\nD. Foster parent training programs may include, but not be\n\nlimited to, in-service training, workshops and seminars developed by\n\nthe state agency; seminars and courses offered through public or\n\nprivate education agencies; and workshops, seminars and courses\n\npertaining to behavioral and developmental disabilities and to the\n\ndevelopment of mutual support services for foster parents.\n\nE. The Department and each child-placing agency shall provide\n\nstatewide training, education, and continuing education programs for\n\nfoster parents.\n\nF. The Department or each child-placing agency shall notify a\n\nfoster parent at least ten (10) business days in advance of the\n\nstatewide scheduling of education, continuing education or foster\n\nparent training occurring near the vicinity of the home of a foster\n\nparent.\n\nG. The Department may also provide additional foster care\n\ntraining to a foster parent.
