Stat. tit. 10A, § 10A-1-9-120v1","heading":"Grievance procedures for foster parents and foster","body":"children.\n\nA. The Office of Client Advocacy and child-placing agencies\n\nshall each establish grievance procedures for foster parents with\n\nwhom the Department of Human Services or child-placing agencies\n\ncontract and for foster children in Department custody. The Office\n\nof Client Advocacy shall work with the Office of Juvenile System\n\nOversight to track foster parent or foster child complaints through\n\nthe grievance procedures and ensure a resolution of the complaint.\n\nB. The procedures established shall contain the following\n\nminimum requirements:\n\n1. Resolution of disputes with foster parents or foster\n\nchildren shall be accomplished quickly, informally and at the lowest\n\npossible level, but shall provide for access to impartial\n\narbitration by management level personnel within the central office;\n\n2. Prompt resolution of grievances no more than sixty (60) days\n\nafter receipt of the grievance or complaint; and\n\n3. Notification to all foster parents and foster children if\n\nage-appropriate upon placement of a child about the grievance\n\nprocedures and how to file a complaint.\n\nC. The Office of Client Advocacy and child-placing agency shall\n\ndesignate one employee at the central office to receive and process\n\nfoster care grievances received by the Office of Juvenile System\n\nOversight.\n\nD. The Office of Client Advocacy and child-placing agency shall\n\nmaintain records of each grievance filed as well as summary\n\ninformation about the number, nature and outcome of all grievances\n\nfiled. The Office of Client Advocacy and the Office of Juvenile\n\nSystem Oversight shall compile an annual report for the Oklahoma\n\nLegislature that details the number of complaints received, the\n\nnumber of complaints resolved, the nature of the complaints and any\n\nother information requested by the Legislature. Agencies shall keep\n\nrecords of grievances separate and apart from other foster parent or\n\nfoster child files. A foster parent, former foster parent, or a\n\nfoster child or former foster child shall have a right of access to\n\nthe record of grievances such person filed after the procedure has\n\nbeen completed.\n\nE. 1. Each foster parent or foster child shall have the right,\n\nwithout fear of reprisal or discrimination, to present grievances\n\nwith respect to the providing or receiving of foster care services.\n\n2. The Department of Human Services shall promptly initiate a\n\nplan of corrective discipline including, but not limited to,\n\ndismissal of any Department employee or cancellation or nonrenewal\n\nof the contract of a child-placing agency determined by the state\n\nagency, through an investigation to have retaliated or discriminated\n\nagainst a foster parent or foster child who has:\n\na. filed a grievance pursuant to the provisions of this\n\nsection,\n\nb. provided information to any official or Department\n\nemployee, or\n\nc. testified, assisted, or otherwise participated in an\n\ninvestigation, proceeding or hearing against the\n\nDepartment or the child-placing agency.\n\n3. The provisions of this subsection shall not be construed to\n\ninclude any complaint by the foster parent or foster child resulting\n\nfrom an administrative, civil or criminal action taken by the\n\nemployee or child-placing agency for violations of law or rules, or\n\ncontract provisions by the foster parent.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"88dd4ab845048e220b8764a3851198cf354d874568bd7162accc0093fffdeb67","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-1-9-120","next":"us-ok/okla.-stat.-tit.-10a-10a-1-9-120v2"},"notice":"GroundRules: Original legal text.
