Stat. tit. 10A, § 10A-2-1-103","heading":"Definitions","body":"When used in the Oklahoma Juvenile Code, unless the context\n\notherwise requires:\n\n1. \"Adjudicatory hearing\" means a hearing to determine whether\n\nthe allegations of a petition filed pursuant to the provisions of\n\nChapter 2 of the Oklahoma Juvenile Code are supported by the\n\nevidence and whether a juvenile should be adjudged to be a ward of\n\nthe court;\n\n2. \"Alternatives to secure detention\" means those services and\n\nfacilities which are included in the State Plan for the\n\nEstablishment of Juvenile Detention Services adopted by the Board of\n\nJuvenile Affairs and which are used for the temporary detention of\n\njuveniles in lieu of secure detention in a juvenile detention\n\nfacility;\n\n3. \"Behavioral health\" means mental health, substance abuse or\n\nco-occurring mental health and substance abuse diagnoses, and the\n\ncontinuum of mental health, substance abuse, or co-occurring mental\n\nhealth and substance abuse treatment;\n\n4. \"Behavioral health facility\" means a mental health or\n\nsubstance abuse facility as provided for by the Inpatient Mental\n\nHealth and Substance Abuse Treatment of Minors Act;\n\n5. \"Board\" means the Board of Juvenile Affairs;\n\n6. \"Child\" or \"juvenile\" means any person under eighteen (18)\n\nyears of age, except for any person charged and convicted for any\n\noffense specified in the Youthful Offender Act or against whom\n\njudgment and sentence has been deferred for such offense, or any\n\nperson who is certified as an adult pursuant to any certification\n\nprocedure authorized in the Oklahoma Juvenile Code for any offense\n\nwhich results in a conviction or against whom judgment and sentence\n\nhas been deferred for such offense;\n\n7. \"Child or juvenile in need of mental health and substance\n\nabuse treatment\" means a juvenile in need of mental health and\n\nsubstance abuse treatment as defined by the Inpatient Mental Health\n\nand Substance Abuse Treatment of Minors Act;\n\n8. \"Child or juvenile in need of supervision\" means a juvenile\n\nwho:\n\na. has repeatedly disobeyed reasonable and lawful\n\ncommands or directives of the parent, legal guardian,\n\nor other custodian,\n\nb. is willfully and voluntarily absent from his or her\n\nhome without the consent of the parent, legal\n\nguardian, or other custodian for a substantial length\n\nof time or without intent to return,\n\nc. is willfully and voluntarily absent from school, as\n\nspecified in Section 10-106 of Title 70 of the\n\nOklahoma Statutes, if the juvenile is subject to\n\ncompulsory school attendance, or\n\nd. has been served with an ex parte or final protective\n\norder pursuant to the Protection from Domestic Abuse\n\nAct;\n\n9. \"Community-based\" means a facility, program or service\n\nlocated near the home or family of the juvenile, and programs of\n\ncommunity prevention, diversion, supervision and service which\n\nmaintain community participation in their planning, operation, and\n\nevaluation. These programs may include but are not limited to\n\nmedical, educational, vocational, social, and psychological\n\nguidance, training, counseling, alcoholism treatment, drug\n\ntreatment, prevention and diversion programs, diversion programs for\n\nfirst-time offenders, transitional living, independent living and\n\nother rehabilitative services;\n\n10. \"Community intervention center\" means a facility which\n\nserves as a short-term reception facility to receive and hold\n\njuveniles for an alleged violation of a municipal ordinance, state\n\nlaw or who are alleged to be in need of supervision, as provided for\n\nin subsection D of Section 2-7-305 of this title;\n\n11. \"Core community-based\" means the following community-based\n\nfacilities, programs or services provided through contract with the\n\nOffice of Juvenile Affairs as provided in Section 2-7-306 of this\n\ntitle:\n\na. screening, evaluation and assessment which includes a\n\nface-to-face screening and evaluation to establish\n\nproblem identification and to determine the risk level\nion 2-7-305 of this title;\n\n11. \"Core community-based\" means the following community-based\n\nfacilities, programs or services provided through contract with the\n\nOffice of Juvenile Affairs as provided in Section 2-7-306 of this\n\ntitle:\n\na. screening, evaluation and assessment which includes a\n\nface-to-face screening and evaluation to establish\n\nproblem identification and to determine the risk level\n\nof a child or adolescent and may result in clinical\n\ndiagnosis or diagnostic impression,\n\nb. treatment planning which includes preparation of an\n\nindividualized treatment plan which is usually done as\n\npart of the screening, evaluation and assessment,\n\nc. treatment plan reviewing which includes a\n\ncomprehensive review and evaluation of the\n\neffectiveness of the treatment plan,\n\nd. individual counseling which includes face-to-face,\n\none-on-one interaction between a counselor and a\n\njuvenile to promote emotional or psychological change\n\nto alleviate the issues, problems, and difficulties\n\nthat led to a referral, including ongoing assessment\n\nof the status and response of the juvenile to\n\ntreatment as well as psychoeducational intervention,\n\ne. group counseling which includes a method of treating a\n\ngroup of individuals using the interaction between a\n\ncounselor and two or more juveniles or parents or\n\nguardians to promote positive emotional or behavioral\n\nchange, not including social skills development or\n\ndaily living skills,\n\nf. family counseling which includes a face-to-face\n\ninteraction between a counselor and the family of the\n\njuvenile to facilitate emotional, psychological or\n\nbehavior changes and promote successful communication\n\nand understanding,\n\ng. crisis intervention counseling which includes\n\nunanticipated, unscheduled face-to-face emergency\n\nintervention provided by a licensed level or qualified\n\nstaff with immediate access to a licensed provider to\n\nresolve immediate, overwhelming problems that severely\n\nimpair the ability of the juvenile to function or\n\nmaintain in the community,\n\nh. crisis intervention telephone support which includes\n\nsupportive telephone assistance provided by a licensed\n\nlevel provider or qualified staff with immediate\n\naccess to a licensed provider to resolve immediate,\n\noverwhelming problems that severely impair the ability\n\nof the juvenile to function or maintain in the\n\ncommunity,\n\ni. case management which includes planned linkage,\n\nadvocacy and referral assistance provided in\n\npartnership with a client to support that client in\n\nself-sufficiency and community tenure,\n\nj. case management and home-based services which includes\n\nthat part of case management services dedicated to\n\ntravel for the purpose of linkage, advocacy and\n\nreferral assistance and travel to provide counseling\n\nand support services to families of children as needed\n\nto support specific youth and families in self-\n\nsufficiency and community tenure,\n\nk. individual rehabilitative treatment which includes\n\nface-to-face service provided one-on-one by qualified\n\nstaff to maintain or develop skills necessary to\n\nperform activities of daily living and successful\n\nintegration into community life, including educational\n\nand supportive services regarding independent living,\n\nself-care, social skills regarding development,\n\nlifestyle changes and recovery principles and\n\npractices,\n\nl. group rehabilitative treatment which includes face-to-\n\nface group services provided by qualified staff to\n\nmaintain or develop skills necessary to perform\n\nactivities of daily living and successful integration\n\ninto community life, including educational and\n\nsupportive services regarding independent living,\n\nself-care, social skills regarding development,\n\nlifestyle changes and recovery principles and\n\npractices,\n\nm. community-based prevention services which include\n\nservices delivered in an individual or group setting\nop skills necessary to perform\n\nactivities of daily living and successful integration\n\ninto community life, including educational and\n\nsupportive services regarding independent living,\n\nself-care, social skills regarding development,\n\nlifestyle changes and recovery principles and\n\npractices,\n\nm. community-based prevention services which include\n\nservices delivered in an individual or group setting\n\nby a qualified provider designed to meet the services\n\nneeds of a child or youth and family of the child or\n\nyouth who has been referred because of identified\n\nproblems in the family or community. The group\n\nprevention planned activities must be focused on\n\nreducing the risk that individuals will experience\n\nbehavioral, substance abuse or delinquency-related\n\nproblems. Appropriate curriculum-based group\n\nactivities include, but are not limited to, First\n\nOffender groups, prevention and relationship\n\nenhancement groups, anger management groups, life\n\nskills groups, substance abuse education groups,\n\nsmoking cessation groups, STD/HIV groups and parenting\n\ngroups,\n\nn. individual paraprofessional services which include\n\nservices delineated in the treatment plan of the\n\njuvenile which are necessary for full integration of\n\nthe juvenile into the home and community, but do not\n\nrequire a professional level of education and\n\nexperience. Activities include assisting families\n\nwith Medicaid applications, assisting with school and\n\nGeneral Educational Development (GED) enrollment,\n\nassisting youth with independent living arrangements,\n\nproviding assistance with educational problems and\n\ndeficiencies, acting as a role model for youth while\n\nengaging them in community activities, assisting youth\n\nin seeking and obtaining employment, providing\n\ntransportation for required appointments and\n\nactivities, participating in recreational activities\n\nand accessing other required community support\n\nservices necessary for full community integration and\n\nsuccessful treatment,\n\no. tutoring which includes a tutor and student working\n\ntogether as a learning team to bring about overall\n\nacademic success, improved self-esteem and increased\n\nindependence as a learner for the student,\n\np. community relations which include public or community\n\nrelations activities directed toward the community or\n\npublic at large or any segment of the public to\n\nencourage understanding, accessibility and use of\n\ncommunity-based facilities, programs or services,\n\nq. children's emergency resource centers that are\n\ncommunity-based and that may provide emergency care\n\nand a safe and structured homelike environment or a\n\nhost home for children providing food, clothing,\n\nshelter and hygiene products to each child served;\n\nafter-school tutoring; counseling services; life-\n\nskills training; transition services; assessments;\n\nfamily reunification; respite care; transportation to\n\nor from school, doctors' appointments, visitations and\n\nother social, school, court or other activities when\n\nnecessary; and a stable environment for children who\n\nhave been detained as delinquent or in need of\n\nsupervision and temporarily placed by a court, or\n\nchildren in crisis who are in custody of the Office of\n\nJuvenile Affairs if permitted under the Office's\n\npolicies and regulations or who have been voluntarily\n\nplaced by a parent or custodian during a temporary\n\ncrisis,\n\nr. transitional living programs which include a\n\nstructured program to help older homeless youth\n\nachieve self-sufficiency and avoid long-term\n\ndependence on social services,\n\ns. community-at-risk services (C.A.R.S.) which include a\n\nprogram provided to juveniles in custody or under the\n\nsupervision of the Office of Juvenile Affairs or a\n\njuvenile bureau to prevent out-of-home placement and\n\nto reintegrate juveniles returning from placements.\n\nThe program shall include, but not be limited to,\n\ntreatment plan development, counseling, diagnostic and\ne on social services,\n\ns. community-at-risk services (C.A.R.S.) which include a\n\nprogram provided to juveniles in custody or under the\n\nsupervision of the Office of Juvenile Affairs or a\n\njuvenile bureau to prevent out-of-home placement and\n\nto reintegrate juveniles returning from placements.\n\nThe program shall include, but not be limited to,\n\ntreatment plan development, counseling, diagnostic and\n\nevaluation services, mentoring, tutoring, and\n\nsupervision of youth in independent living,\n\nt. first offender programs which include alternative\n\ndiversion programs, as defined by Section 2-2-404 of\n\nthis title, and\n\nu. other community-based facilities, programs or services\n\ndesignated by the Board as core community-based\n\nfacilities, programs or services;\n\n12. \"Day treatment\" means a program which provides intensive\n\nservices to juveniles who reside in their own home, the home of a\n\nrelative, or a foster home. Day treatment programs include\n\neducational services and may be operated as a part of a residential\n\nfacility;\n\n13. \"Delinquent child or juvenile\" means a juvenile who:\n\na. has violated any federal or state law or municipal\n\nordinance except a traffic statute or traffic\n\nordinance or any provision of the Oklahoma Wildlife\n\nConservation Code, the Oklahoma Vessel and Motor\n\nRegulation Act or the Oklahoma Boating Safety\n\nRegulation Act, or has violated any lawful order of\n\nthe court made pursuant to the provisions of the\n\nOklahoma Juvenile Code, or\n\nb. has habitually violated traffic laws, traffic\n\nordinances or boating safety laws or rules;\n\n14. \"Dispositional hearing\" means a hearing to determine the\n\norder of disposition which should be made with respect to a juvenile\n\nadjudged to be a ward of the court;\n\n15. \"Executive Director\" means the Executive Director of the\n\nOffice of Juvenile Affairs;\n\n16. \"Facility\" means a place, an institution, a building or\n\npart thereof, a set of buildings, or an area whether or not\n\nenclosing a building or set of buildings which is used for the\n\nlawful custody and treatment of juveniles. A facility shall not be\n\nconsidered a correctional facility subject to the provisions of\n\nTitle 57 of the Oklahoma Statutes;\n\n17. \"Graduated sanctions\" means a calibrated system of\n\nsanctions designed to ensure that juvenile offenders face uniform,\n\nimmediate, and consistent consequences that correspond to the\n\nseriousness of each offender's current offense, prior delinquent\n\nhistory, and compliance with prior interventions;\n\n18. \"Group home\" means a residential facility with a program\n\nwhich emphasizes family-style living in a homelike environment.\n\nSaid group home may also offer a program within the community to\n\nmeet the specialized treatment needs of its residents. A group home\n\nshall not be considered a correctional facility subject to the\n\nprovisions of Title 57 of the Oklahoma Statutes;\n\n19. \"Independent living program\" means a program designed to\n\nassist a juvenile to enhance skills and abilities necessary for\n\nsuccessful adult living and may include but shall not be limited to\n\nminimal direct staff supervision and supportive services in making\n\nthe arrangements necessary for an appropriate place of residence,\n\ncompleting an education, vocational training, obtaining employment\n\nor other similar services;\n\n20. \"Institution\" means a residential facility offering care\n\nand treatment for more than twenty residents. An institution shall\n\nnot be considered a correctional facility subject to the provisions\n\nof Title 57 of the Oklahoma Statutes. Said institution may:\n\na. have a program which includes community participation\n\nand community-based services, or\n\nb. be a secure facility with a program exclusively\n\ndesigned for a particular category of resident;\n\n21. \"Juvenile detention facility\" means a facility which is\nto the provisions\n\nof Title 57 of the Oklahoma Statutes. Said institution may:\n\na. have a program which includes community participation\n\nand community-based services, or\n\nb. be a secure facility with a program exclusively\n\ndesigned for a particular category of resident;\n\n21. \"Juvenile detention facility\" means a facility which is\n\nsecured by locked rooms, buildings and fences, and meets the\n\ncertification standards of the Office and which is entirely separate\n\nfrom any prison, jail, adult lockup, or other adult facility, for\n\nthe temporary care of children. A juvenile detention facility shall\n\nnot be considered a correctional facility subject to the provisions\n\nof Title 57 of the Oklahoma Statutes;\n\n22. \"Municipal juvenile facility\" means a facility other than a\n\ncommunity intervention center that accepts a child under eighteen\n\n(18) years of age charged with violating a municipal ordinance and\n\nmeets the requirements of Section 2-2-102 of this title;\n\n23. \"Office\" means the Office of Juvenile Affairs;\n\n24. \"Peer Review\" means an initial or annual review and report\n\nto the Office of Juvenile Affairs of the organization, programs,\n\nrecords and financial condition of a Youth Services Agency by the\n\nOklahoma Association of Youth Services, or another Oklahoma\n\nnonprofit corporation whose membership consists solely of Youth\n\nServices Agencies and of whom at least a majority of Youth Services\n\nAgencies are members. An annual review may consist of a review of\n\none or more major areas of the operation of the Youth Services\n\nAgency being reviewed;\n\n25. \"Person responsible for a juvenile's health or welfare\"\n\nincludes a parent, a legal guardian, custodian, a foster parent, a\n\nperson eighteen (18) years of age or older with whom the juvenile's\n\nparent cohabitates or any other adult residing in the home of the\n\nchild, an agent or employee of a public or private residential home,\n\ninstitution or facility, or an owner, operator, or employee of a\n\nchild care facility as defined by Section 402 of Title 10 of the\n\nOklahoma Statutes;\n\n26. \"Preliminary inquiry\" or \"intake\" means a mandatory,\n\npreadjudicatory interview of the juvenile and, if available, the\n\nparents, legal guardian, or other custodian of the juvenile, which\n\nis performed by a duly authorized individual to determine whether a\n\njuvenile comes within the purview of the Oklahoma Juvenile Code,\n\nwhether nonadjudicatory alternatives are available and appropriate,\n\nand if the filing of a petition is necessary;\n\n27. \"Probation\" means a legal status created by court order\n\nwhereby a delinquent juvenile is permitted to remain outside an\n\nOffice of Juvenile Affairs facility directly or by contract under\n\nprescribed conditions and under supervision by the Office, subject\n\nto return to the court for violation of any of the conditions\n\nprescribed;\n\n28. \"Rehabilitative facility\" means a facility maintained by\n\nthe state exclusively for the care, education, training, treatment,\n\nand rehabilitation of juveniles in need of supervision;\n\n29. \"Responsible adult\" means a stepparent, foster parent,\n\nperson related to the juvenile in any manner who is eighteen (18)\n\nyears of age or older, or any person having an obligation and\n\nauthority to care for or safeguard the juvenile in the absence of\n\nanother person who is eighteen (18) years of age or older;\n\n30. \"Secure detention\" means the temporary care of juveniles\n\nwho require secure custody in physically restricting facilities:\n\na. while under the continuing jurisdiction of the court\n\npending court disposition, or\n\nb. pending placement by the Office of Juvenile Affairs\n\nafter adjudication;\n\n31. \"Secure facility\" means a facility, maintained by the state\n\nexclusively for the care, education, training, treatment, and\n\nrehabilitation of delinquent juveniles or youthful offenders which\ny in physically restricting facilities:\n\na. while under the continuing jurisdiction of the court\n\npending court disposition, or\n\nb. pending placement by the Office of Juvenile Affairs\n\nafter adjudication;\n\n31. \"Secure facility\" means a facility, maintained by the state\n\nexclusively for the care, education, training, treatment, and\n\nrehabilitation of delinquent juveniles or youthful offenders which\n\nrelies on locked rooms and buildings, and fences for physical\n\nrestraint in order to control behavior of its residents. A secure\n\nfacility shall not be considered a correctional facility subject to\n\nthe provisions of Title 57 of the Oklahoma Statutes;\n\n32. \"Transitional living program\" means a residential program\n\nthat may be attached to an existing facility or operated solely for\n\nthe purpose of assisting juveniles to develop the skills and\n\nabilities necessary for successful adult living. Said program may\n\ninclude but shall not be limited to reduced staff supervision,\n\nvocational training, educational services, employment and employment\n\ntraining, and other appropriate independent living skills training\n\nas a part of the transitional living program; and\n\n33. \"Youth Services Agency\" means a nonprofit corporation with\n\na local board of directors, officers and staff that has been\n\ndesignated by the Board as a Youth Services Agency, that is peer\n\nreviewed annually, and that provides community-based facilities,\n\nprograms or services to juveniles and their families in the youth\n\nservices service area in which it is located.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"427533b95b615fe2d57ea5c735c5ce7e728435b4fdd403c9cfec12a13fc148fd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-2-1-102","next":"us-ok/okla.-stat.-tit.-10a-10a-2-10-101"},"notice":"GroundRules: Original legal text.
