Stat. tit. 10A, § 10A-2-2-105","heading":"Order removing child from home prohibited absent","body":"certain determinations.\n\nNo order of the court providing for the initial or continued\n\nremoval of a child alleged or adjudicated delinquent or in need of\n\nsupervision from the child’s home shall be entered unless the court\n\nfinds that the continuation of the child in the home of the child is\n\ncontrary to the welfare of the child. The order shall include\n\neither:\n\n1. A determination as to whether or not reasonable efforts have\n\nbeen made to prevent the need for the removal of the child from the\n\nhome or, as appropriate, reasonable efforts have been made to\n\nprovide for the return of the child to the home; or\n\n2. A determination as to whether or not an absence of efforts\n\nto prevent the removal of the child from the home is reasonable upon\n\nconsideration of the family circumstances, the safety of the child\n\nand the protection of the public; or\n\n3. A determination that reasonable efforts to prevent the\n\nremoval of the child from the home or to reunify the child and\n\nfamily are not required because:\n\na. a court of competent jurisdiction has determined that\n\nthe parent has subjected the child to one of the\n\nfollowing aggravated circumstances: abandonment,\n\ntorture, chronic abuse, sexual abuse or chronic, life-\n\nthreatening neglect of the child,\n\nb. a court of competent jurisdiction has determined that\n\nthe parent has been convicted of one of the following:\n\n(1) murder of another child of the parent,\n\n(2) voluntary manslaughter of another child of the\n\nparent,\n\n(3) aiding or abetting, attempting, conspiring, or\n\nsoliciting to commit such a murder or such a\n\nvoluntary manslaughter, or\n\n(4) a felony assault that results in serious bodily\n\ninjury to the child or another child of the\n\nparent, or\n\nc. the parental rights of the parent with respect to a\n\nsibling have been terminated involuntarily.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bbc8a82e8134c36f16c7a90f0d025786daf5751e669f30347f7deca6efb84d2e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-2-2-104.1","next":"us-ok/okla.-stat.-tit.-10a-10a-2-2-106"},"notice":"GroundRules: Original legal text.
