Stat. tit. 10A, § 10A-2-2-401.1","heading":"Definitions","body":"As used in Sections 2-2-401.1 through 2-2-401.7 of this title:\n\n1. \"Competent\" and \"competency\" refer to a child's ability to\n\nunderstand the nature and objectives of a proceeding against the\n\nchild or to assist in the child's defense. A child is incompetent\n\nif, due to developmental disability, developmental immaturity,\n\nintellectual disability, or mental illness, the child is presently\n\nincapable of understanding the nature and objective of proceedings\n\nagainst the child or of assisting in the child's defense;\n\n2. \"Credentialed forensic evaluator\" means a licensed\n\npsychologist, psychiatrist or other physician with necessary\n\neducation, training, and experience to perform juvenile competency\n\nevaluations, and who has been approved to render such opinions for\n\nthe court;\n\n3. \"Developmental disability\" means a severe and chronic\n\ndisability that is attributable to a mental or physical impairment.\n\nSuch disabilities include, but are not limited to, cerebral palsy,\n\nepilepsy, autism, or other neurological conditions that lead to\n\nimpairment of general intellectual functioning or adaptive behavior;\n\n4. \"Developmental immaturity\" means a condition based on a\n\njuvenile's chronological age and significant lack of developmental\n\nskills when the juvenile has no significant mental illness or\n\nintellectual disability;\n\n5. \"Intellectual disability\" means a disability characterized\n\nby significant limitations both in intellectual functioning and in\n\nadaptive behavior as expressed in conceptual, social and practical\n\nadaptive skills;\n\n6. \"Mental illness\" has the same meaning as in paragraph 11 of\n\nSection 5-502 of Title 43A of the Oklahoma Statutes; and\n\n7. \"Proceeding\" means any delinquency or youthful offender\n\nproceeding under the Oklahoma Juvenile Code.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d74a4a3fc03c7568b4942341cbb39fdf19a6a0c8f34ee439193b063326b12b53","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-2-2-401","next":"us-ok/okla.-stat.-tit.-10a-10a-2-2-401.2"},"notice":"GroundRules: Original legal text.
