The Oklahoma Commission on Children and Youth shall\n\nadminister a grievance process to be utilized by children detained\n\nin an adult jail, adult lockup, adult detention or other adult\n\nfacility. The grievance process shall be available to a child at\n\nany time prior to or after adjudication or conviction or during his\n\nor her incarceration. Grievances may be filed either by the child\n\nor by a person responsible for the juvenile's health or welfare as\n\ndefined by Section 2-1-103 of Title 10A of the Oklahoma Statutes\n\nacting on the child's behalf.\n\nB. Grievances shall be directed to the Commission's Office of\n\nJuvenile System Oversight for investigation, resolution and referral\n\nto the appropriate agency if deemed necessary, including, but not\n\nlimited to, the State Department of Health.\n\n1. The Office of Juvenile System Oversight shall have the\n\nauthority to investigate complaints, including, but not limited to,\n\nthe following:\n\na. placement,\n\nb. treatment,\n\nc. psychological services,\n\nd. social services,\n\ne. educational services,\n\nf. recreation,\n\ng. abuse, neglect or misconduct,\n\nh. cleanliness and hygiene, and\n\ni. routine problems with employees, contractors or other\n\nincarcerated persons within the facility.\n\n2. The Office of Juvenile System Oversight shall notify the\n\nOffice of Juvenile Affairs compliance monitor or designee when a\n\ngrievance is received. The Office of Juvenile System Oversight\n\nshall notify the Department of Human Services when a grievance is\n\nreceived regarding a child in the custody of the Department of Human\n\nServices.\n\nC. Each facility in which children are being held shall:\n\n1. Make all grievance policies and procedures available upon\n\nrequest to any member of the public;\n\n2. Make grievance policies and procedures readily accessible to\n\nany children in the facility; and\n\n3. Explain all grievance policies and procedures to every child\n\nduring his or her intake at the facility.\n\nD. The Oklahoma Commission on Children and Youth shall\n\npromulgate rules for the purposes of administering this section that\n\nare consistent with grievance procedures available to children\n\ndetained in juvenile detention facilities as promulgated by the\n\nOffice of Juvenile Affairs.\n\nE.
