Stat. tit. 10A, § 10A-2-7-101","heading":"Board of Juvenile Affairs - Members - Duties and","body":"responsibilities.\n\nA. There is hereby created the Board of Juvenile Affairs which\n\nshall consist of the following nine (9) members:\n\n1. Five members appointed by the Governor;\n\n2. Two members appointed by the Speaker of the House of\n\nRepresentatives; and\n\n3. Two members appointed by the President Pro Tempore of the\n\nSenate.\n\nB. 1. Each member shall serve at the pleasure of his or her\n\nappointing authority and may be removed or replaced without cause.\n\n2. Any member of the Board shall be prohibited from voting on\n\nany issue in which the member has a direct financial interest.\n\n3. The Executive Director of the Office of Juvenile Affairs\n\nshall be an ex officio member of the Board, but shall be entitled to\n\nvote only in case of a tie vote.\n\nC. To be eligible for appointment to the Board a person shall:\n\n1. Be a citizen of the United States;\n\n2. Be a resident of this state;\n\n3. Be a qualified elector of this state; and\n\n4. Not have been convicted of a felony pursuant to the laws of\n\nthis state, the laws of any other state, or the laws of the United\n\nStates.\n\nD. Members appointed pursuant to this paragraph shall include\n\npersons having experience in social work, juvenile justice, criminal\n\njustice, community-based youth services, criminal-justice-related\n\nbehavioral sciences, indigent defense, and education. In making the\n\nappointments, the Governor shall also give consideration to urban,\n\nrural, gender, and minority representation.\n\nE. 1. The Board shall hold meetings as necessary at a place\n\nand time to be fixed by the Board. The Board shall elect, at its\n\nfirst meeting, one of its members to serve as chair and another of\n\nits members to serve as vice-chair. At the first meeting in each\n\ncalendar year thereafter, the chair and vice-chair for the ensuing\n\nyear shall be elected. Special meetings may be called by the chair\n\nor by five members of the Board by delivery of written notice to\n\neach member of the Board. A majority of members serving on the\n\nBoard shall constitute a quorum of the Board.\n\n2. Members of the Board shall receive necessary travel expenses\n\naccording to the provisions of the State Travel Reimbursement Act,\n\nbut shall receive no other compensation. Travel expenses shall be\n\npaid from funds available to the Office of Juvenile Affairs.\n\nF. The Board shall:\n\n1. Adopt and promulgate rules for its government and may adopt\n\nan official seal for the Office of Juvenile Affairs;\n\n2. Be the rulemaking body for the Office of Juvenile Affairs;\n\n3. Review and approve the budget request of the Office of\n\nJuvenile Affairs to the Governor;\n\n4. Assist the Office of Juvenile Affairs in conducting periodic\n\nreviews and planning activities related to the goals, objectives,\n\npriorities, and policies of the Office;\n\n5. Provide a public forum for receiving comments and\n\ndisseminating information to the public and the regulated community\n\nregarding goals, objectives, priorities, and policies of the Office\n\nof Juvenile Affairs at least quarterly. The Board shall have the\n\nauthority to adopt nonbinding resolutions requesting action by the\n\nOffice of Juvenile Affairs in response to comments received or upon\n\nthe Board's own initiative; and\n\n6. Establish contracting procedures for the Office of Juvenile\n\nAffairs and guidelines for rates of payment for services provided by\n\ncontract.\n\nG. 1. As the rulemaking body of the Office of Juvenile\n\nAffairs, the Board is specifically charged with the duty of\n\npromulgating rules which will implement the duties and\n\nresponsibilities of the Office pursuant to the Oklahoma Juvenile\n\nCode.\n\n2. Effective July 1, 1995, any administrative policies adopted\n\nby the Commission for Human Services related to personnel and other\n\nadministrative issues and any rules promulgated relating to the\n\ncustody, care and supervision of children adjudicated to be\n\ndelinquent or in need of supervision shall be and remain in effect\nresponsibilities of the Office pursuant to the Oklahoma Juvenile\n\nCode.\n\n2. Effective July 1, 1995, any administrative policies adopted\n\nby the Commission for Human Services related to personnel and other\n\nadministrative issues and any rules promulgated relating to the\n\ncustody, care and supervision of children adjudicated to be\n\ndelinquent or in need of supervision shall be and remain in effect\n\nuntil amended or new rules are promulgated by the Board of Juvenile\n\nAffairs.\n\n3. Any rules adopted by the Commission for Human Services\n\nrelated to personnel and other administrative issues and the\n\ncustody, care and supervision of children adjudicated to be\n\ndelinquent or in need of supervision and subject to review by the\n\nLegislature during the 1st Session of the 45th Oklahoma Legislature\n\nmay be finally adopted and promulgated by the Board of Juvenile\n\nAffairs pursuant to the Administrative Procedures Act.\n\n4. Starting April 1, 1995, the Board of Juvenile Affairs shall\n\nconduct an internal review of current permanent and emergency rules\n\nrelating to the custody, care and supervision of children\n\nadjudicated to be delinquent or in need of supervision to determine\n\nwhether such rules need to be amended, or repealed, reinstated, or\n\nrecodified. By January 1, 1997, the Board shall have adopted\n\npermanent rules to implement the programs and functions within its\n\njurisdiction and shall submit such rules for legislative review\n\npursuant to Article I of the Administrative Procedures Act.\n\n5.
