There is hereby created the Office of Juvenile Affairs which\n\nshall be responsible for programs and services for youthful\n\noffenders and juveniles alleged or adjudicated to be delinquent or\n\nin need of supervision. The Executive Director shall be responsible\n\nfor established divisions and appointing Division Directors within\n\nthe Office of Juvenile Affairs.\n\nB. Suitable office space shall be provided by the Office of\n\nManagement and Enterprise Services to the Office of Juvenile\n\nAffairs, to the extent necessary for the Office to implement its\n\njurisdictional duties provided by the Oklahoma Juvenile Code, and\n\nthe Office may incur necessary expenses for office rent.\n\nC. Effective July 1, 1995, the Office of Juvenile Affairs shall\n\nbe a Merit System agency and all employees of the Office of Juvenile\n\nAffairs shall be classified employees who are subject to the\n\nOklahoma Personnel Act and the Merit System of Personnel\n\nAdministration, except as otherwise provided by law. Eligible\n\npersons employed as teachers by the Office of Juvenile Affairs shall\n\nbe entitled to paid maternity leave as provided for in Section 1 of\n\nthis act. Effective June 1, 2020, employees hired for service at\n\nthe Southwest Oklahoma Juvenile Center in Manitou shall be\n\nconsidered unclassified and employed in a term-limited appointment.\n\nIf state services continue at the facility after the designated\n\nterm, the employee may be transferred into a non-term-limited\n\nposition. Current employees and employees hired prior to June 1,\n\n2020, shall not be subject to this provision.\n\nD. Effective July 1, 1995, within its jurisdictional areas of\n\nresponsibility, the Office of Juvenile Affairs, acting through the\n\nExecutive Director, or persons authorized by law, rule or designated\n\nby the Executive Director to perform such acts, shall have the power\n\nand duty to:\n\n1. Advise, consult, cooperate and enter into agreements with\n\nagencies of the state, municipalities and counties, other states and\n\nthe federal government, and other persons;\n\n2. Enter into agreements for, accept, administer and use,\n\ndisburse and administer grants of money, personnel and property from\n\nthe federal government or any department or agency thereof, or from\n\nany state or state agency, or from any other source, to promote and\n\ncarry on in this state any program within its jurisdictional area of\n\nresponsibility;\n\n3. Require the establishment and maintenance of records and\n\nreports;\n\n4. Establish a system of training for personnel in order to\n\nassure uniform statewide application of law and rules;\n\n5. Enforce the provisions of the Oklahoma Juvenile Code and\n\nrules promulgated thereunder and orders issued pursuant thereto;\n\n6. Charge and receive fees pursuant to fee schedules\n\npromulgated by the Board of Juvenile Affairs;\n\n7. Conduct studies, research and planning of programs and\n\nfunctions, pursuant to the authority granted by the Oklahoma\n\nJuvenile Code;\n\n8. Enter into interagency agreements;\n\n9. Provide administrative and support services to the Board of\n\nJuvenile Affairs as necessary to assist the Board in the performance\n\nof its duties;\n\n10. Establish and maintain such facilities and institutions as\n\nare necessary or convenient for the operation of programs for\n\nchildren under the jurisdiction of the Office of Juvenile Affairs;\n\n11. Lease, from time to time, any real property which the Board\n\nof Juvenile Affairs shall determine advisable to more fully carry\n\ninto effect the operation of the Office of Juvenile Affairs in\n\naccordance with applicable state statutes. All such leases for real\n\nproperty shall be subject to the provisions of Section 63 of Title\n\n74 of the Oklahoma Statutes;\n\n12. Purchase or lease any equipment, supplies or materials\n\npursuant to the Oklahoma Central Purchasing Act;\n\n13. Contract for professional services;\no more fully carry\n\ninto effect the operation of the Office of Juvenile Affairs in\n\naccordance with applicable state statutes. All such leases for real\n\nproperty shall be subject to the provisions of Section 63 of Title\n\n74 of the Oklahoma Statutes;\n\n12. Purchase or lease any equipment, supplies or materials\n\npursuant to the Oklahoma Central Purchasing Act;\n\n13. Contract for professional services;\n\n14. Acquire, construct, extend, and operate any and all\n\nfacilities of all kinds which in the judgment of the Executive\n\nDirector and the approval of the Legislature shall be necessary or\n\nconvenient to carry out the duties of the Office of Juvenile\n\nAffairs, as authorized by law;\n\n15. Establish an employee recruitment and referral incentive\n\nprogram and promulgate internal agency policy for the operation of\n\nthe program, which may include, but shall not be limited to, program\n\npurposes, pay incentives for employees, eligibility requirements,\n\npayment conditions and amounts, payment methods, payment recoupment,\n\nand record keeping; and\n\n16. Exercise all incidental powers which are necessary and\n\nproper to implement and administer the purposes of the Oklahoma\n\nJuvenile Code.\n\nE. The Office of Juvenile Affairs shall maintain a fair, simple\n\nand expeditious system for resolution of grievances of all persons\n\ncommitted to the Office of Juvenile Affairs regarding the substance\n\nor application of any written or unwritten policy, rule of the Board\n\nof Juvenile Affairs or of an agent or contractor of the Office of\n\nJuvenile Affairs or any decision, behavior or action by an employee,\n\nagent or contractor or by any other person committed to the Office\n\nof Juvenile Affairs.\n\nF. Effective November 1, 2012, the Office of Juvenile Affairs\n\nshall establish a system of certification in accordance with the\n\nOklahoma Child Care Facilities Licensing Act for the shelters\n\nmanaged and operated by the Department of Human Services pursuant to\n\nthe requirements of Section 1-9-111 of this title.
