There is hereby created in the State Treasury a revolving\n\nfund for the Office of Juvenile Affairs to be designated the\n\n\"Juvenile Detention Improvement Revolving Fund\". The fund shall be\n\na continuing fund, not subject to fiscal year limitations, and shall\n\nconsist of all monies appropriated to the Juvenile Detention\n\nImprovement Revolving Fund and monies which may otherwise be\n\navailable to the Office of Juvenile Affairs for use as provided for\n\nin this section.\n\nB. All monies appropriated to the fund shall be budgeted and\n\nexpended by the Office of Juvenile Affairs for the purpose of\n\nproviding funds to counties to renovate existing juvenile detention\n\nfacilities, to construct new juvenile detention facilities, to\n\noperate juvenile detention facilities and otherwise provide for\n\nsecure juvenile detention services and alternatives to secure\n\ndetention as necessary and appropriate, in accordance with state-\n\napproved juvenile detention standards and the State Plan for the\n\nEstablishment of Juvenile Detention Services provided for in Section\n\n2-3-103 of this title. The participation of local resources shall\n\nbe a requirement for the receipt by counties of said funds and the\n\nDepartment shall establish a system of rates for the reimbursement\n\nof secure detention costs to counties. The methodology for the\n\nestablishment of said rates may include, but not be limited to,\n\nconsideration of detention costs, the size of the facility, services\n\nprovided and geographic location. Expenditures from said fund shall\n\nbe made upon warrants issued by the State Treasurer against claims\n\nfiled as prescribed by law with the Director of the Office of\n\nManagement and Enterprise Services for approval and payment.\n\n1. The rate of reimbursement of approved operating cost shall\n\nbe eighty-five percent (85%) for the Office of Juvenile Affairs and\n\nfifteen percent (15%) for the county.\n\n2. The rate of reimbursement of approved operating cost shall\n\nbe one hundred percent (100%) for the Office of Juvenile Affairs for\n\na child in the custody of the Office of Juvenile Affairs after\n\nadjudication and disposition who is held in a juvenile detention\n\nfacility when the child is pending a placement consistent with the\n\ntreatment needs of that child as identified by the Office of\n\nJuvenile Affairs.\n\n3. The Office of Juvenile Affairs shall approve only those\n\napplications for funds to renovate an existing juvenile detention\n\nfacility or any other existing facility or to construct a new\n\njuvenile detention facility which contain proposed plans that are in\n\ncompliance with state-approved juvenile detention standards.\n\n4. The Office of Juvenile Affairs shall approve only those\n\napplications or contracts for funds to operate juvenile detention\n\nfacilities or otherwise provide for secure juvenile detention\n\nservices and alternatives to secure detention which are in\n\ncompliance with or which are designed to achieve compliance with the\n\nState Plan for the Establishment of Juvenile Detention Services\n\nprovided for in Section 2-3-103 of this title.\n\n5. The Office of Juvenile Affairs shall, from appropriated\n\nstate monies or from available federal grants, provide for payment\n\npursuant to contract for transportation personnel and vehicle-\n\nrelated costs and reimburse for eligible travel costs for counties\n\nutilizing the juvenile detention facilities identified in the \"State\n\nPlan for the Establishment of Juvenile Detention Services\" in\n\naccordance with the provisions of the State Travel Reimbursement Act\n\nand in accordance with Section 2-3-103 of this title.","path":["OK Code","Title 10A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os10A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f4b73c03f803bd0dc5464fc6bbe913b17ff32042f2057b9569f247db53bb3d5a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-10a-10a-2-7-311","next":"us-ok/okla.-stat.-tit.-10a-10a-2-7-402"},"notice":"GroundRules: Original legal text.
