The Office of Juvenile Affairs shall establish and maintain\n\nsuch methods of administration, including those necessary to\n\nestablish and maintain a merit system of personnel administration,\n\nand shall promulgate such rules as it deems necessary for the\n\nefficient and effective operation of the juvenile institutions and\n\nfacilities operated by the Office.\n\nB. The Executive Director of the Office of Juvenile Affairs\n\nshall employ and fix the duties and compensation of a\n\nsuperintendent, and such other personnel as the Executive Director\n\ndeems necessary, for each of the juvenile institutions and\n\nfacilities operated by the Office of Juvenile Affairs. The Office\n\nshall promulgate, and in its hiring and employment practices, the\n\nOffice shall adhere to, written minimum qualifications by position\n\nfor personnel working with or around juveniles in said institutions\n\nand facilities. Such minimum qualifications shall be designed to\n\nassure that such personnel possess sufficient education, training,\n\nexperience and background to provide adequate and safe professional\n\ncare and services to said juveniles; and that the juveniles will not\n\nbe exposed to abuse, deprivation, criminal conduct, or other\n\nunwholesome conditions attributable to employee incompetence or\n\nmisconduct.\n\nC. 1. The Office of Juvenile Affairs may directly request\n\nnational criminal history records searches as defined by Section\n\n150.9 of Title 74 of the Oklahoma Statutes from the Oklahoma State\n\nBureau of Investigation for the purpose of investigating the\n\ncriminal history of any employee or applicant of the Office of\n\nJuvenile Affairs. The Oklahoma State Bureau of Investigation may\n\ncharge a search fee as provided in Section 150.9 of Title 74 of the\n\nOklahoma Statutes. The fee shall be deposited in the OSBI Revolving\n\nFund.\n\n2. The Board of Juvenile Affairs shall promulgate rules for the\n\nOffice of Juvenile Affairs to obtain national criminal history\n\nrecords for personnel described in subsection B of this section,\n\nexcept that such rules may permit employment of applicants pending\n\nreceipt of the results of national criminal history record searches.\n\nD.
