This act shall be known and may be cited as the “Juvenile\n\nJustice Public Works Act”.\n\nB. As used in the Juvenile Justice Public Works Act:\n\n1. “Director” means the Director of the Office of Juvenile\n\nAffairs;\n\n2. “Public works project” means a project that has been\n\ndetermined by the Director of the Office of Juvenile Affairs to be\n\nnecessary for the public well-being and conducive to rehabilitation\n\nand the reduction of recidivism among participating juveniles or\n\nyouthful offenders; and\n\n3. “Juvenile or youthful offender” means any person who is\n\nunder the custody and control of the Office of Juvenile Affairs.\n\nC. The Office of Juvenile Affairs shall establish and maintain\n\nthe Juvenile Justice Public Works Program. The purpose of the\n\nJuvenile Justice Public Works Program shall be to:\n\n1. Provide labor for community service projects in order to\n\ndevelop lands pursuant to public works projects;\n\n2. Provide improvements and beautification to public lands and\n\nbuildings; and\n\n3. Reduce recidivism for juvenile or youthful offenders by\n\naiding such individuals in transitioning between institutions and\n\nthe community.\n\nD. No juvenile or youthful offender shall be assigned to any\n\npublic works project if the offender:\n\n1. Is deemed by the Director to be a threat to public safety;\n\nor\n\n2. Has escaped or attempted to escape from an institution or\n\nother placement within the last year.\n\nE. The Board of Juvenile Affairs shall promulgate rules as\n\nnecessary to implement the provisions of the Juvenile Justice Public\n\nWorks Act. At a minimum, the rules shall provide guidelines that\n\nestablish criteria for selection and assignment to the Juvenile\n\nJustice Public Works Program and the duties to be performed by the\n\nparticipants in the program.\n\nF. The Juvenile Justice Public Works Act shall not be construed\n\nto restore, in whole or in part, the civil rights of any juvenile or\n\nyouthful offender. No juvenile or youthful offender participating\n\nin the Juvenile Justice Public Works Program shall be considered an\n\nemployee of the state or the Office of Juvenile Affairs, nor shall\n\nany such participant be subject to the provisions of the labor laws\n\nof this state. Any eligible juvenile or youthful offender assigned\n\nto the Juvenile Justice Public Works Program shall be exempt from\n\nthe provisions of the Workers’ Compensation Act.\n\nG. 1. All state and local government agencies, nonprofit\n\norganizations, community service agencies, educational programs and\n\nother treatment programs are immune from liability for torts\n\ncommitted by or against any eligible juvenile or youthful offender\n\nassigned to the Juvenile Justice Public Works Program, except that\n\nthe Office of Juvenile Affairs shall provide basic or necessary\n\nmedical and dental care to the juvenile or youthful offenders placed\n\nin the program in such instances.\n\n2. Without waiving the immunity of the state, the Executive\n\nDirector of the Office of Juvenile Affairs may authorize the repair\n\nor replacement of the personal property of a third party if the\n\npersonal property is damaged or destroyed by a juvenile or youthful\n\noffender who is in the custody of the Office of Juvenile Affairs and\n\nwhile participating in the Juvenile Justice Public Works Program.\n\nAny personal property repaired or replaced shall be comparable in\n\nkind, quality and cost to the original property.
