Stat. tit. 10A, § 10A-2-8-224","heading":"Purchase, receipt or possession of tobacco or vapor","body":"products by those under 21 prohibited - Falsifying proof of age -\n\nPenalties.\n\nA. It is unlawful for a person who is under twenty-one (21)\n\nyears of age to purchase, receive, or have in his or her possession\n\na tobacco product, nicotine product or vapor product, or to present\n\nor offer to any person any purported proof of age which is false or\n\nfraudulent, for the purpose of purchasing or receiving any tobacco\n\nproduct, nicotine product or vapor product. It shall not be\n\nunlawful for an employee under twenty-one (21) years of age to\n\nhandle tobacco products, nicotine products or vapor products when\n\nrequired in the performance of the employee's duties.\n\nB. When a person violates subsection A of this section, the\n\nviolator shall complete an education or tobacco use cessation\n\nprogram approved by the court. If the violator fails to complete\n\nthe tobacco use cessation program ordered by the court, a fine may\n\nbe imposed that shall not exceed Fifty Dollars ($50.00) for a first\n\noffense or One Hundred Dollars ($100.00) for subsequent offenses.\n\nThe violator may also be required to complete a community service\n\nprogram or other appropriate programs or services as ordered by the\n\ncourt. The court shall have jurisdiction over the violator for\n\ntwelve (12) months following sentencing to ensure all programs and\n\norders of the court are followed.\n\nC. The ABLE Commission shall establish rules to provide for\n\nnotification to a parent or guardian of any minor cited for a\n\nviolation of this section.\n\nD. Cities and towns may enact and municipal police officers may\n\nenforce ordinances prohibiting and penalizing conduct in violation\n\nof this section.\n\nE.
