Any employee, officer, contractor, or volunteer who\n\nknowingly fails to report incidents of sexual misconduct or coercive\n\nbehavior shall be deemed to be acting outside the scope of\n\nemployment and therefore be subject to civil liability exempt from\n\nThe Governmental Tort Claims Act including, but not limited to,\n\ndamages for physical, emotional, and psychological harm caused to\n\nthe juvenile.\n\nB. The Office of Juvenile Affairs and any contracted entity or\n\ngroup home operating under the Office’s supervision shall be liable\n\nfor damages if a court of competent jurisdiction finds that the\n\nemployee, officer, contractor, or volunteer was negligent in\n\npreventing, investigating, or responding to reports of sexual\n\nmisconduct. Liability for acts committed in violation of this\n\nsection shall be exempt from the liability limitations under The\n\nGovernmental Tort Claims Act.\n\nC. Negligence under this act shall include failure to properly\n\ntrain employees on mandatory reporting, failure to respond to\n\nprevious reports, failure to terminate employees who abuse\n\njuveniles, or failure to take action to safeguard juveniles from\n\nknown risks.\n\nD. Juvenile victims, their parents or legal guardians, or next\n\nfriends may file civil actions seeking damages pursuant to the\n\nprovisions of this section.\n\nE.
